论我国立法过程中的利益衡量

【摘要】：我国目前正处于经济和社会的转型时期,伴随着建设有中国特色社会主义社会的步伐,我国已出现了利益多元化的格局,现实生活中各种利益冲突潜伏其中,并且不时会出现矛盾激化的局面。努力构建法治社会是解决社会利益冲突的最佳途径,依法治国是社会主义法治的核心内容,创制良好的法律既可以规范社会秩序,又可以从源头上减少社会矛盾,而立法的过程实质上是各利益主体利益表达和利益整合的过程,因此研究立法过程中的利益衡量对创设良法、减少社会冲突是十分必要的。本篇论文第一章由利益的定义引申出利益衡量的定义及其价值目标；第二章从利益冲突理论出发分析立法过程中利益衡量的必要性、立法过程中利益衡量的范围和过程以及立法过程中的利益衡量标准和原则；第三章详细介绍我国立法利益衡量中利益表达的主体、意义和方式以及利益整合的内容、过程和原则；第四章则通过分析利益衡量的局限性,并且结合我国的立法现状,从立法过程中利益衡量的角度提出完善我国立法的建议。
[Abstract]:At present, our country is in the period of economic and social transformation. With the pace of building a socialist society with Chinese characteristics, there has been a pattern of diversification of interests in our country, in which various conflicts of interest lurk in real life. And from time to time, contradictions will intensify the situation. To build a society ruled by law is the best way to solve the conflict of social interests. Ruling the country by law is the core content of the socialist rule of law. Creating good laws can not only standardize social order, but also reduce social contradictions at the source. The process of legislation is essentially the process of interest expression and interest integration of the main interests, so it is necessary to study the interest measurement in the legislative process to create a good law and reduce social conflicts. In the first chapter of this paper, the definition of interest and its value goal are derived from the definition of interest. The second chapter analyzes the necessity of interest measurement in the legislative process from the theory of conflict of interest. The scope and process of the interest measurement in the legislative process and the standards and principles of the interest measurement in the legislative process; the third chapter introduces in detail the main body, significance and method of the interest expression in the legislative interest measurement of our country, as well as the content of the interest integration. The fourth chapter analyzes the limitations of interest measurement and puts forward some suggestions on how to perfect our country's legislation from the angle of interest measurement in the legislative process combined with the current situation of our country's legislation.
