【摘要】：马克思主义法治思想是马克思主义法哲学高度凝练的思想与规律,是我国法治政府建设的理论基础,它指导着我国法治政府的建设,规范着我国法治政府建设的行为。人类的政治实践表明,以法治维持的社会秩序,其价值、正义都更有利于社会的稳定与和谐。建设法治政府既是当前经济社会发展对政府自身提出的内在要求,也是实现政治文明的必然道路。我国的法治政府建设自2004年开始以来,经过十几年的不断发展,已初步形成基本框架,但是在有些方面依然存在不少问题。目前距离2020年基本建成法治政府的目标已无太多时日,法治政府建设的任务可谓任重道远。本文系统梳理了马克思主义经典作家及中国特色社会主义法治思想的主要内容,厘清其对我国法治政府建设的相关指导部分,为我国的法治政府建设提供了坚实的理论保障。在马克思主义法治思想的指导下,我国法治政府建设取得显著成绩:行政体制改革不断深化、政府运行机制日渐规范、政府立法质量明显提高、法治政府制度体系初步形成等。但我们还必须清楚地认识到,无论是从理念深入还是制度建构,都会发现我国的法治政府建设依然存在不少问题。正是这些问题促使我们继续前进,不断探寻我国法治政府建设的路径,立足于当前我国法治政府建设的现状,以马克思主义法治思想为指导,从执政理念、主体行为、制度完善、环境建设等四方面,系统地探讨了在新形势下建设法治政府的对策,充实和发展了马克思主义法治思想的理论宝库。
[Abstract]:Marxist thought of rule of law is the highly condensed thought and law of Marxist philosophy of law and the theoretical basis of the construction of our country's legal government. It guides the construction of our country's government by law and standardizes the behavior of our country's construction of government by law. Human political practice shows that the value and justice of the social order maintained by the rule of law are more conducive to social stability and harmony. Building a government ruled by law is not only the internal requirement of the current economic and social development to the government itself, but also the inevitable way to realize political civilization. Since the construction of our country's government by law began in 2004, after more than ten years of continuous development, the basic framework has been formed, but there are still many problems in some aspects. At present, there is not much time before the goal of building a government ruled by law by 2020, and the task of building a government ruled by law can be described as a long way off. This paper systematically combs the main contents of Marxist classic writers and socialist rule of law thoughts with Chinese characteristics, clarifies the relevant guiding parts of the construction of our country's rule of law government, and provides a solid theoretical guarantee for the construction of our country's rule of law government. Under the guidance of Marxist thought of rule of law, the construction of government ruled by law in China has made remarkable achievements: the reform of administrative system is deepening, the operating mechanism of government is becoming more and more standardized, the quality of government legislation has been improved obviously, and the system of government system of rule of law has been initially formed. However, we must also clearly realize that there are still many problems in the construction of the government ruled by law in our country, whether from the depth of the concept or the construction of the system. It is these problems that urge us to continue to advance, to explore the path of the construction of the government by law in our country, to base ourselves on the current situation of the construction of the government by law in our country, to take the Marxist thought of the rule of law as the guide, from the governing idea, the main body behavior, This paper systematically discusses the countermeasures of constructing the government by law under the new situation and enriches and develops the theoretical treasure-house of Marxist thought of rule by law.
