【摘要】:不动产,作为一个国家和社会最重要的财产之一,是一个国家或民族生存发展的基础资源。不动产登记制度不仅是保护不动产交易安全、提高交易效率的重要制度基础,同时保障了国家对不动产的有效监督和调控,因此是一项极其重要的制度。无论是英美法系国家亦或是大陆法系国家,都十分重视不动产登记制度的完善,而且许多国家已经颁布了符合本国实际且便于科学操作的不动产登记法律法规。随着《物权法》的出台,我国不动产登记制度也逐步向完善、统一的方向快速发展,但由于《物权法》中关于不动产登记之规定仅是宏观上的,因此在实践运用过程中仍因缺乏参考而处于比较混乱的状态。与我国有着一衣带水相邻关系的日本,目前已经形成了比较系统的不动产登记制度。因此,本文希望通过将两国不动产登记制度的重要内容进行详细对比分析,能够为我国不动产登记制度的完善提供借鉴资料。 文章论题为中日不动产登记制度比较研究,全文共分五章: 第一章不动产物权变动及公示制度。总体阐述了物权变动的历史流变、物权公示公信原则及物权变动模式的选择与发展。重点介绍我国和日本物权变动相关制度的发展过程和特点。 第二章中日不动产登记制度立法之比较。介绍了中日两国不动产登记模式的选择、中日两国对不动产之界定和中日两国房地关系制度及特点等与不动产登记立法相关重要问题,是探讨和理解中日两国不动产登记制度具体差异的前提和基础。 第三章是关于中日两国不动产登记类型的比较,,通过对比分析两国法律法规和学术理论,论证两国不动产登记类型之具体规定与制度根源之间的联系。 第四章是关于不动产登记机关、登记簿等不动产程序问题的对比。该部分内容采用列图表等对比形式,更加形象展现两国不动产登记程序上之差异。 第五章阐述我国不动产登记制度的现状和完善建议。以我国《物权法》中涉及的不动产登记相关规定为视角,通过中日对比的方法,客观分析我国不动产登记制度的成果与不足。并根据《物权法》对不动产登记制度的纲领性规定,提出一些具体的完善建议。
[Abstract]:Real estate, as one of the most important property of a country and society, is the basic resource for the survival and development of a country or a nation. The real estate registration system is not only the important system foundation to protect the real estate transaction security and improve the transaction efficiency, but also ensures the effective supervision and control of the real estate by the state, so it is an extremely important system. Both Anglo-American law countries and civil law countries attach great importance to the perfection of real estate registration system, and many countries have promulgated laws and regulations of real estate registration which accord with their actual conditions and are convenient for scientific operation. With the introduction of the Real right Law, the registration system of real estate in our country has been developed rapidly in the direction of perfection and unification. However, the regulation on the registration of real estate in the Law of Real Rights is only macroscopic. Therefore, the process of practice is still in a more chaotic state because of lack of reference. Japan, which has a close relationship with our country, has formed a systematic real estate registration system. Therefore, this paper hopes to compare and analyze the important contents of the real estate registration system in the two countries in order to provide reference for the improvement of the real estate registration system in our country. The thesis is about the comparative study of the real estate registration system between China and Japan, which is divided into five chapters: Chapter one: real property right change and publicity system. This paper expounds the historical change of real right change, the principle of publicizing public credit of real right and the choice and development of real right change mode. This paper mainly introduces the development process and characteristics of the system of real right change in China and Japan. The second chapter compares the legislation of real estate registration system between China and Japan. This paper introduces the choice of real estate registration mode between China and Japan, the definition of real estate in China and Japan, and the system and characteristics of the relationship between China and Japan, and so on, which are related to the legislation of real estate registration. It is the premise and foundation of discussing and understanding the difference of real estate registration system between China and Japan. The third chapter is about the comparison of the types of real estate registration between China and Japan, through the comparative analysis of the laws and regulations of the two countries and academic theory, demonstrate the relationship between the specific provisions of the two countries' real estate registration type and the root of the system. The fourth chapter is about the real estate registration authority, registration book and other real estate procedures. In this part, the difference of real estate registration procedures between the two countries is shown more vividly in the form of tables and graphs. The fifth chapter elaborates the present situation and the perfect suggestion of the real estate registration system in our country. From the perspective of the relevant regulations of real estate registration in the Real right Law of our country, this paper analyzes objectively the achievements and shortcomings of the real estate registration system in China through the method of comparison between China and Japan. According to the programmatic regulation of real estate registration system, some concrete suggestions are put forward.
