近代湘商商事调解探究（1900-1937）

【摘要】：建立完善纠纷解决机制是构建和谐稳定社会的重要内容,商事调解作为多元化纠纷解决机制的重要组成部分,虽然发挥着积极作用,但仍然存在不足之处。历史上,近代中国包括湖南因经济结构发生转变,新式工商业的发展,商事纠纷也随之增多,既有的纠纷处理机制已无法有效解决商事纠纷,稳定社会秩序,晚清政府为巩固其自身统治,开始了商事立法活动。1904年清朝廷颁布《商会简明章程》,规定商会具有调解商事纠纷的能力,期望通过地方商会的建立缓解官府受诉压力,维护社会稳定。到民国时期,政府为进一步规范商事纠纷的处理,公布了《商事公断处章程》,再次强调商会的商事调解职能。由于国家政策的推行和民间力量的发展,商事调解因其独特优势成为近代湖南商事纠纷的主要解决方式。但随着抗日战争的爆发,湖南地区商事活动遭遇极大影响,商事调解也逐渐衰弱。但不可否认的是,商事调解在近代湖南商事纠纷解决方面发挥了重要作用。笔者希望通过对近代湘商商事调解的考察,为当今商事调解机制的完善以及多元化纠纷解决机制的构建提供有益参考,达到以古鉴今的目的。本文内容由引言、正文三章共四个部分构成,其中引言部分主要阐述了本文的选题缘由和研究意义,并简单介绍了学术界相关研究成果。正文第一章为近代湘商商事调解的概念以及发展过程,该部分从近代湘商和商事调解两个方面界定近代湘商商事调解的概念,并简单梳理了近代湘商商事调解的发展脉络。第二章为近代湘商商事调解机制,分别从商事调解的主体,商事调解的客体,商事调解的依据和商事调解运行的主要步骤四个方面探究近代湘商商事调解机制,并结合相关案例分析总结该时期商事调解所呈现的特征。第三章则为近代湘商商事调解的成效和影响,从对近代商事纠纷案例的整理分析来看,商事调解作为一种重要的社会治理方式,其取得显著成效的同时,也对后世产生了深刻的影响。
[Abstract]:Establishing and perfecting the dispute resolution mechanism is an important content of building a harmonious and stable society. Commercial mediation, as an important part of the pluralistic dispute resolution mechanism, plays an active role, but there are still some shortcomings. In history, due to the transformation of economic structure in modern China, including Hunan, with the development of new-style industry and commerce, the number of commercial disputes has increased, and the existing dispute handling mechanism has been unable to effectively resolve commercial disputes and stabilize social order. In 1904, the Qing Dynasty promulgated the Concise Charter of the Chamber of Commerce, which stipulated that the Chamber of Commerce had the ability to mediate commercial disputes, and hoped to alleviate the pressure on the government to be sued through the establishment of local chambers of commerce. Maintain social stability. During the period of the Republic of China, in order to further standardize the handling of commercial disputes, the government published the articles of Association of Commercial Arbitration, emphasizing once again the commercial mediation function of the Chamber of Commerce. Due to the implementation of national policy and the development of folk power, commercial mediation has become the main way to solve commercial disputes in modern Hunan because of its unique advantages. However, with the outbreak of the War of Resistance against Japan, commercial activities in Hunan suffered a great impact and commercial mediation gradually weakened. However, it is undeniable that commercial mediation played an important role in the settlement of commercial disputes in modern Hunan. The author hopes to provide a useful reference for the perfection of commercial mediation mechanism and the construction of diversified dispute resolution mechanism through the investigation of Hunan commercial mediation in modern times, so as to achieve the purpose of learning from the past and the present. The content of this paper is composed of four parts: introduction and three chapters, in which the preface mainly explains the reason and significance of this paper, and briefly introduces the academic research results. The first chapter is the concept and development process of modern Hunan commercial mediation, which defines the concept of modern Hunan commercial mediation from the two aspects of modern Hunan merchants and commercial mediation, and simply combs the development of modern Hunan commercial mediation. The second chapter is the modern Hunan commercial mediation mechanism, respectively from the commercial mediation of the subject, the object of commercial mediation, the basis of commercial mediation and the main steps of commercial mediation operation of modern Hunan commercial mediation mechanism. Combined with the analysis of relevant cases, this paper summarizes the characteristics of commercial mediation in this period. The third chapter is about the effect and influence of Hunan commercial mediation in modern times. From the analysis of modern commercial dispute cases, commercial mediation, as an important social governance method, has achieved remarkable results at the same time. It also had a profound impact on later generations.
