论全球化背景下法律趋同化与差异化

【摘要】：当人类社会生活的发展进入到由经济全球化带来的一体化时代,其最直接的效应就是将各国独立的市场联系起来,国与国之间贸易的边界开始逐渐模糊。随着法律全球化的展开,随之而来的是各国在不同方面法律规制的趋同化(Legal Convergence)。这种趋同化逐渐从制度的趋同化扩大到法理、法律原则、法哲学等抽象理论的趋同化。虽然趋同化是法律全球化时代的主要趋势,但这只是法律全球化进程一方面的体现,其另一方面法律差异化(Legal Divergence)常常被全球化主流价值观所忽略。文本旨在分析法律全球化下法律趋同化的原因及理论,以TR IPs——典型的知识产权法律全球化表现形式之一为例,关注在法律趋同化大趋势下,各国自身吸收、本土化国际规则与制度的过程中所产生的差异化。
[Abstract]:When the development of human social life enters the era of integration brought by economic globalization, its most direct effect is to connect the independent markets of each country, and the boundary of trade between countries begins to blur gradually. With the development of legal globalization, the legal Convergence is becoming more and more common in different countries. The assimilation gradually extends from the assimilation of institution to the assimilation of abstract theories, such as legal theory, legal principle and legal philosophy. Although convergence is the main trend in the era of legal globalization, it is only the embodiment of the process of legal globalization on the one hand, and on the other hand, legal differentiation is often ignored by the mainstream values of globalization. The purpose of the text is to analyze the reasons and theories of legal assimilation under the legal globalization. Taking tr IPs-one of the typical manifestations of intellectual property legal globalization as an example, the paper pays attention to the absorption of countries themselves under the general trend of legal assimilation. The differentiation in the process of localization of international rules and systems.
