论“反向混淆”概念之不必要

【摘要】："反向混淆"是来自美国法的概念,通常的商标侵权是将在后使用人的商品误认为在先商标权人的,谓之"正向混淆",而"反向混淆"则指将在先商标权人的商品误认为在后使用人的。我国商标法理论和实践中似乎越来越多地关注和认可了"反向混淆"的概念。从商标法理论和实践的发展,从我国法与美国法的不同,以及从"混淆可能性"判断为法律问题而非事实问题三个层面论述了在我国目前的商标法理论框架以及司法实践中,"混淆可能性"的概念足以解决相关问题,"反向混淆"概念既缺乏存在的理论和逻辑前提,也没有必要。
[Abstract]:"reverse confusion" is a concept derived from American law, and the common trademark infringement is the mistake of the goods of the latter user as the prior trademark owner. The term "positive confusion" and "reverse confusion" refer to those which mistake the goods of the prior trademark owner as the later user. The theory and practice of trademark law in China seem to pay more and more attention to the concept of reverse confusion. From the development of trademark law theory and practice, from the difference between Chinese law and American law, And from the three aspects of judging the possibility of confusion as a legal problem rather than a matter of fact, this paper discusses that the concept of "obfuscation possibility" is sufficient to solve the related problems in the current theoretical framework of trademark law and judicial practice in China. The concept of "towards confusion" lacks both the theoretical and logical premises of existence, There is no need.
