【摘要】：董仲舒"经义决狱"是在西汉初期实施"休养生息"政策,在西汉中期有利于改正"汉承秦制"而带来的法律过于残暴、严苛的弊病。自汉武帝之后,儒家"经义"对封建法制建设的牢固地位不曾改变。
[Abstract]:The policy of "recuperation and recuperation" was carried out in the early Western Han Dynasty by Dong Zhongshu. In the middle of the Western Han Dynasty, the law brought about by the "Han Dynasty into Qin Dynasty" was too cruel and harsh. Since Emperor Wu of the Han Dynasty, the Confucian Confucian classics and righteousness has not changed its firm position in the construction of feudal legal system.
