【摘要】：民国时期的法律家王宠惠在中国法制现代化进程中起过重要作用,不仅在国内法学界地位显赫,在国际法学界也是声名远播,近来逐渐被学界广泛关注。本文立足于国内外学者关于王宠惠宪政思想的研究成果以及认识评价,从宪政思想的内涵入手,考察了王宠惠宪政思想形成的背景,阐述了王宠惠的宪政思想,分析了王宠惠宪政思想的内在矛盾及产生原因,并对如何准确认识王宠惠的宪政思想提出了自己的看法。最后结合中国现实情况尝试性地探讨了王宠惠宪政思想与实践带给我们的历史启示,体现了法学对社会现实的关注。第一部分是绪论。介绍了民国第一法学家王宠惠,讨论了宪政思想的主要内涵,陈述了研究现状,最后指出了本课题的研究方法与意义。第二部分主要分析了王宠惠宪政思想形成的背景。包括民国初年的宪政发展以及王宠惠的学习经历、政治经历。第三部分主要针对王宠惠的宪政思想及实践进行分析。创制根本法,追求宪政精神；制定良法,构建近代法律体系；坚持三权分立思想；倡导司法独立思想。第四部分分析了王宠惠宪政思想的内在矛盾与产生原因。包括司法党化、联省自治思潮、好政府主义思潮。并讨论了这些内在矛盾产生的原因。第五部分探讨了王宠惠宪政思想与实践的历史地位与历史启示。我们应准确认识王宠惠的宪政思想,借鉴带给我们的历史启示,为我国法治建设服务。总之,我们要坚持历史唯物主义的观点,将王宠惠政治立场和学术贡献分离开来,辩证的看待这一历史伟人,我们要对其法律思想和实践进行深入研究,吸收其中有利于法治建设的有益成分,为我国的宪政建设提供参考。
[Abstract]:Wang Chonghui, the Legalism of the Republic of China, played an important role in the process of modernization of China's legal system, not only in the domestic law circles, but also in the international law field. Recently, it has been widely paid attention to by the academic circles. This article is based on the research achievements and cognitive evaluation of Wang Chonghui Xian Zhengsi at home and abroad, and from the constitutional thought. The background of the formation of Wang Chonghui's constitutional thought is examined, the constitutional thought of Wang Chonghui is expounded, the inner contradictions and causes of Wang Chonghui's constitutional thought are analyzed, and his own views on how to understand Wang Chonghui's constitutional thought are put forward. Finally, Wang Chonghui Xian Zhengsi is tentatively discussed in the light of the reality of China. The historical revelation that thought and practice bring to us reflects the concern of law to social reality.
The first part is the introduction. Introduced the first jurist Wang Chonghui in the Republic of China, discussed the main connotation of constitutional thought, stated the research status, and finally pointed out the research methods and significance of the subject.
The second part mainly analyzes the background of Wang Chonghui's constitutional thought, including the development of constitutional government in early Republic of China and Wang Chonghui's learning experience and political experience.
The third part mainly analyzes Wang Chonghui's constitutional thought and practice, creating the root law, pursuing the spirit of constitutional government, formulating the good law, constructing the modern legal system, insisting on the separation of the three powers, and advocating the independence of the judiciary.
The fourth part analyzes the internal contradictions and causes of Wang Chonghui's constitutional thought, including the judicial party, the ideological trend of provincial autonomy, and the thought of good government, and discusses the reasons for the inherent contradictions.
The fifth part discusses the historical status and historical enlightenment of Wang Chonghui's constitutional thought and practice. We should know Wang Chonghui's constitutional thought accurately, draw lessons from the history and serve the construction of the rule of law in our country.
In a word, we should adhere to the viewpoint of historical materialism and separate Wang Chonghui's political position from academic contribution and dialectically look at the great man of history. We should study its legal thought and practice deeply, absorb the beneficial elements which are beneficial to the construction of the rule of law, and provide reference for the construction of constitutional government in our country.
