法律与社会规范：一个博弈论的分析视角

【摘要】：本文以法律与社会规范的一般理论出发,论述了法律与社会规范在概念上的界定、互动关系以及法律与社会关系的研究现状的评述;再以一次乡野调查为背景,对《物权法》上的“领地通行权”和当地习惯规则的“外面先收,里面后收”进行了比较和分析,展开论证了法律与社会规范之间的冲突,以法经济学和博弈论的方法阐述了社会规范适用的原因和条件,最后论证了社会规范和法律二者不可相互替代,社会规范在其作用的空间时间范围内达到暂时性的纳什均衡,一旦冲破了语境论以及内部环境的制约,社会规范的效力将降低最终被新的社会规范取代。而法律以其普适性和稳定性将作用于更为广阔的外部环境。本文在论述上分为七个部分,第一部分阐述了法律与社会规范的一般理论,包括二者的界定、互动关系以及研究现状的评述;第二部分以一项田野调查为背景导入了法律与社会规范存在的现实冲突,即“邻地通行权”的尴尬;第三章阐述了《物权法》中“领地通行权”的规定,包括立法宗旨、国内外的相关立法规定;第四章评述了有关邻地通行的“外面先收,里面后收”的习惯法规则,其中包含了规则的形成、执行、监督等问题;第五章、第六章分别从经济学和博弈论的角度论述了法律与社会规范的冲突与调适,最后对论证进行结论与反思。本文首先从理论层面关注了法律和社会规范之间互动关系,也探究了二者的相同与不同,并在理论研究的基础上做了假设即社会规范存在有其特定的背景和条件,一旦背景或条件发生改变,社会规范的效用将随之发生改变,当旧的社会规范无法在调试新的纠纷,无法再适应社会背景条件,那么新的社会规范必将取而代之。法律调试的范围远大与社会规范,但社会规范还将长期存在下去。本文设定了特定的乡野背景,引用了一项乡野调查的数据对理论假设进行了分析,从语境论、法经济学和博弈论角度对理论假设进行了系统论证,最后得出结论。
[Abstract]:Based on the general theory of law and social norms, this paper discusses the definition of law and social norms in concept, the relationship between law and social relations, and the current research situation of law and social relations. This paper compares and analyzes the "territorial right of communication" in the "property Law" and the local customary rule of "collecting first, inside and then", and demonstrates the conflict between law and social norms. This paper expounds the reasons and conditions for the application of social norms by the methods of law and economics and game theory, and finally proves that social norms and laws cannot be replaced each other, and that social norms reach a temporary Nash equilibrium within the space and time range of their functions. Once the theory of context and the restriction of internal environment are broken, the effectiveness of social norms will be reduced and eventually replaced by new social norms. Law, with its universality and stability, will act on a broader external environment. This paper is divided into seven parts. The first part describes the general theory of law and social norms, including the definition of the two, interactive relations and a review of the status quo; The second part introduces the realistic conflict between law and social norms based on a field survey, that is, the embarrassment of "neighboring land right", the third chapter expounds the provisions of "territorial right of communication" in the property Law, including the purpose of legislation. The fourth chapter reviews the customary law rules of "outside first, inside and then", which include the formation, implementation, supervision and so on of the rules. Chapter six discusses the conflict and adjustment between law and social norms from the angle of economics and game theory. This paper first pays attention to the interaction between law and social norms from the theoretical level, and explores the similarities and differences between the two, and on the basis of theoretical research, makes a hypothesis that the existence of social norms has its own specific background and conditions. Once the background or condition changes, the effectiveness of social norms will change. When the old social norms can not debug new disputes, can no longer adapt to the social background conditions, then the new social norms will be replaced. The scope of legal debugging and social norms, but social norms will continue to exist for a long time. In this paper, the specific background of the countryside is set, and the theoretical hypotheses are analyzed by citing the data of a rural survey. The theoretical hypotheses are systematically demonstrated from the perspectives of context theory, law and economics, and game theory, and finally the conclusions are drawn.
