法律帝国主义、法律东方主义与中国的法治道路

【摘要】:"法律东方主义"是一种批判理论,它旨在批判和解构西方法治话语自我建构出来的"普世性",还原其地方性和相对性。在否认东方有不同于西方的政治—法律传统,将东方视为有待西方去殖民、去传播福音和文明之对象的同时,西方丧失了通过文明间的平等对话来完善其自身政治—法律文明的机会。对于中国法律人而言,法律东方主义这一分析视角的意义并不在于让我们用西方人自己提供的武器来揭露"西方法律的虚伪性",而在于帮助我们破除"自我东方主义"的困境,以开放、自信的心态去建构体现文明主体性的法治话语。
[Abstract]:"legal Orientalism" is a critical theory, which aims at criticizing and deconstructing the "universality" of the western discourse of rule of law, and restoring its locality and relativity. While denying that the East has a political-legal tradition different from that of the West, it sees the Orient as an object to be decolonized by the West to preach the gospel and civilization. The West lost the opportunity to perfect its own political-legal civilization through equal dialogue among civilizations. For Chinese legal people, the significance of legal Orientalism is not to expose "the hypocrisy of western law" with the weapon provided by Westerners themselves, but to help us overcome the dilemma of "eorientalism". Open, self-confident attitude to construct a civilized subjectivity of the rule of law discourse.
