法治反腐的推进思路及方法

【摘要】：党的十八大以来,习近平总书记多次强调用法治思维和法治方式反腐败。特别是在党的十八届四中全会上,强调要加快推进反腐败国家立法,完善惩治和预防腐败体系,坚决遏制和预防腐败现象。"法治反腐"在党的反腐历史上被提升到了前所未有的战略高度。因而,如何充分认识和理解法治反腐的深刻内涵,凝聚法治反腐的社会共识,担当起法治反腐的职能责任,是一个学术理论界和司法实务界亟待予以合力破解的时代课题。本文从坚定法治反腐的理论自信与行动自觉、推进党内法规同国家法律的有机衔接、强化检察机关的反腐职能、运用法治思维和法治方式解决反腐实务问题等四个维度对此进行了阐释。
[Abstract]:Since the 18th National Congress of the Party, General Secretary Xi Jinping has repeatedly stressed the use of rule of law thinking and ways to combat corruption. In particular, at the fourth Plenary session of the 18th CPC Central Committee, it was stressed that it is necessary to speed up the promotion of national anti-corruption legislation, improve the system of punishing and preventing corruption, and resolutely curb and prevent corruption. " Anti-corruption by law "has been promoted to an unprecedented strategic height in the history of anti-corruption of the Party." Therefore, how to fully understand and understand the profound connotation of anti-corruption by law, to consolidate the social consensus of anti-corruption by law, and to assume the functional responsibility of anti-corruption by law is an urgent task for the academic theorists and judicial practitioners to work together to crack it. In this paper, the author tries to strengthen the anti-corruption function of procuratorial organs by strengthening the theoretical self-confidence and action consciousness of the rule of law, promoting the organic connection between the laws and regulations within the Party and the laws of the state. The author explains this from four dimensions: thinking of rule by law and solving practical problems of corruption by rule of law.
