明代申明亭初探

【摘要】：申明亭制度作为明太祖始创的中国明代重要的基层法律调解制度，很值得探讨。本文分为三个部分：第一部分分别从申明亭的成因、职能和易于被接受的原因三点来探析申明亭制度的具体内容。第二部分探讨了申明亭重要角色里老人以及里老调解制度，，然后对其实施的利弊进行了评论。第三，探讨明代申明亭制度的实践和思想以及对当代社会的启示。最后是结语部分。一是本文的学术意义。二是探讨其对当今社会调解制度的启示。本文是在学术界研究成果的基础上完成的，没有前人的辛勤耕耘就没有本文。但本文并不完全是已有成果的简单拼凑组合，自认为有所创新，有所更正，有所补充。创新主要有两点，一是申明亭的调节范围并不仅仅是学界一般意义上认为的民事纠纷和轻微刑事案件，也包括一部分严重刑事案件；第二点则是自己在完善我国现有基层民间调解制度方面的小小构想，提出了一些具体措施，仅供参考。
[Abstract]:It is worth discussing that Pavilion system, as an important legal mediation system of the Ming Dynasty, was founded by Taizu of Ming Dynasty. This paper is divided into three parts: The first part analyzes the concrete contents of the declaration pavilion system from three aspects: the causes, functions and the easily accepted reasons. The second part discusses the important role of the elderly and the elderly mediation system, and then comments on the advantages and disadvantages of its implementation. Thirdly, it discusses the practice and thought of the system of affirmation pavilions in the Ming Dynasty and its enlightenment to the contemporary society. The last part is the conclusion. The first is the academic significance of this paper. The second is to probe into its enlightenment to the social mediation system today. This paper is based on the academic research results, without the previous hard work, there is no this paper. However, this paper is not a simple patchwork combination of existing achievements, which is thought to be innovative, corrected and supplemented. There are two main points in innovation. One is that the adjustment scope of pavilion is not only civil disputes and minor criminal cases, but also some serious criminal cases. The second point is their own in the improvement of our existing grass-roots folk mediation system small ideas, put forward some specific measures, only for reference.
