功利主义视角下法律价值的认知逻辑

【摘要】：全面推进依法治国,良法是善治的前提。以功利主义为视角重新检讨法律价值(公平与秩序)这一法理学基本命题,具有理论与实践的双重意义。公平要素基于正当性证明命题、共同体的正义命题、功利主义原理而展开,秩序要素依赖法律实证主义基本命题来表达。公平与秩序通过自然法层面的"分"与"合"揭示了法律价值的内在意蕴。秩序要素所涵摄的法律实用性问题在功利主义的指引下演化为法律与社会的关系问题,利益法学的引入则实现了法律价值与功利主义的对接,从而拓展了法律价值的研究思路。
[Abstract]:To comprehensively promote the rule of law, good law is the premise of good governance. It is of both theoretical and practical significance to review the legal value (fairness and order) as a basic proposition of jurisprudence from the perspective of utilitarianism. The elements of fairness are based on the propositions of justification, justice of the community, and utilitarianism, and the elements of order are expressed by the basic propositions of legal positivism. Fairness and order reveal the inner meaning of legal value through the "division" and "combination" of natural law. Under the guidance of utilitarianism, the legal practicability of order elements has evolved into the relationship between law and society, and the introduction of interest jurisprudence has realized the docking of legal value and utilitarianism, thus expanding the research ideas of legal value.
