【摘要】：欧洲中央银行是根据《马斯特里赫特条约》在1998年正式成立的,欧洲央行成为欧洲中央银行体系的核心机构,同时也成为欧盟的核心金融机构。欧洲央行在欧盟构建体系中占有重要地位,欧洲央行的法定权力对欧盟及其各成员国也有重要意义。但是,国内学界对欧洲央行权力的研究多数是从经济学角度进行的,而从法学角度对欧洲央行权力的研究却非常少。随着欧元区主权债务危机的爆发,欧洲央行开始启动直接货币交易项目进行成员国主权债券购买举措,而这一举措引起了欧洲央行体系内部乃至整个国际社会的争论,欧洲中央银行法定权力的相关问题一跃成为国际金融法领域最热门的问题。本文从法学角度对欧洲央行法定权力的相关问题进行研究,并在文中着重探讨欧洲央行法定权力在法学领域的争议问题。文章围绕欧洲央行法定权力的界定、欧洲央行法定权力的分类、欧洲央行法定权力的行使以及欧洲央行法定权力的效力四个方面对欧洲中央银行的法定权力进行研究。以案例研究的方法对欧盟法院审理的案例中欧洲央行参与的典型案例进行分析,并在此基础上讨论欧洲央行的越权行为和起诉欧洲央行的主体资格问题。以比较研究方法对国际上的中央银行权力进行探讨,分析监管权与货币权的关系。以比较研究方法对欧洲央行的法定权力与协定权力的要素进行对比,得出法定权力与协定权力的非对立关系和欧洲央行的权力应属于法定权力的结论。以法经济学研究的方法考量欧洲央行法定权力行使中存在的利益冲突问题。经过上述研究方法的运用,以欧洲央行的权力界定、权力内容、权力行使、权力审查以及权力效力等几个方面构建出欧洲央行法定权力的研究框架,并提出欧洲央行法定权力需要进一步规制的问题,如问责制等问题。
[Abstract]:The European Central Bank (ECB) was formally established in 1998 under the Maastricht Treaty. The ECB has become the core institution of the European Central Bank system as well as the core financial institution of the European Union. The ECB plays an important role in the construction of the European Union, and the ECB's statutory powers are also important to the EU and its member states. However, most of the researches on the power of the European Central Bank are carried out from the angle of economics, but the study of the power of the European Central Bank from the angle of law is very few. With the onset of the euro zone's sovereign debt crisis, the European Central Bank has launched a direct currency trading program to buy sovereign bonds of member states, which has caused controversy within the ECB system and in the international community as a whole. The question of the legal powers of the European Central Bank has become the hottest issue in the field of international financial law. This paper studies the legal power of the European Central Bank from the point of view of law, and focuses on the controversy of the legal power of the European Central Bank in the field of law. This paper focuses on the definition of the statutory powers of the ECB, the classification of the statutory powers of the ECB, the exercise of the statutory powers of the ECB and the effectiveness of the statutory powers of the ECB. This paper analyzes the typical cases in which the European Central Bank (ECB) is involved in the case heard by the European Union Court of Justice by case study, and on this basis discusses the question of the ECB's ultra vires behavior and the subject qualification of the prosecution of the ECB. This paper discusses the power of the central bank in the world by means of comparative research, and analyzes the relationship between the right of supervision and the right of money. By comparing the legal power of the European Central Bank with the elements of the agreement power, the conclusion is drawn that the legal power and the agreement power are not in opposition and the power of the European Central Bank should belong to the statutory power. The conflict of interest in the exercise of the legal power of the European Central Bank (ECB) is considered by means of legal and economic research. Through the application of the above research methods, the research framework of the legal power of the European Central Bank is constructed from the following aspects: the definition of power, the content of power, the exercise of power, the review of power and the effectiveness of power, and so on. It also points out that the ECB's statutory powers need to be regulated further, such as accountability.
