【摘要】:法学教育对建立法治社会具有重要的意义。因此,研究法学教育在今天具有极为重要的价值。现代意义上的法学教育,是从清末开始启蒙、诞生,经北京政府、南京国民政府的大力调整与推动而逐渐发展起来的,继而经过改革开放的三十多年而发展到今天的局面。在这长达一百多年的历史中,南京国民政府时期在整个法学教育的发展历程中占有相当重要的分量。一方面法学教育在此阶段逐步走向正轨和完善,培养了众多的法学人才,推动了中国法学教育的现代化和法治建设进程;另一方面,此时期的法学教育制度也具有一定的缺陷,对于现今的法学教育具有重要的参考价值,可以提供丰富的经验与启示,以推动当今法学教育的发展和完善。 为了深入、全面地了解南京国民政府时期法学教育的全貌,探究当时法学教育的特点,挖掘其经验与启示,本文采用比较研究、动态研究、史实阐述与史识探究等多种方法,将文章分为绪论、正文和结论三大部分进行研究。其中正文的主体部分又包含四个方面的内容,分别为清末民初近代法学教育的诞生、南京国民政府法学教育思想的确立与实施、南京国民政府法学教育体制的发展完善、南京国民政府法学教育的特点与启示。 第一部分采用动态的方法,将近代法学教育诞生的历史过程进行了简单的梳理,揭示了法学教育诞生的背景,阐述了清末民初的法学教育体制及其特点,作为南京国民政府法学教育研究的起点,同时将二者进行简单对比。 第二、三、四部分是文章的重点与核心内容,主要围绕南京国民政府时期的法学教育展开深入而又突出重点的研究。 第二部分主要对南京国民政府法学教育思想的确立以及有关政策、法律的实施进行阐述,重点比较近现代法学教育思想与中国传统教育思想之间的差异,并且分析造成这种差异的原因以及变化的过程。 第三部分是对法学教育体制展开史实性的描述与史识性的评价,通过对法学教育管理体制、教育机构、办学形式、学制、学分、课程设置、教师、学生等诸方面的阐述,深刻地理解和探究当时法学教育的状况,并分析其内在的逻辑。 第四部分是对南京国民政府的法学教育进行抽象概括与总结,从法学教育的思想、体制等方面概括其特点,并且总结当时法学教育对现今中国法学教育的经验与启示,探究中国现代意义上的法学教育所面临的困境与发展的方向。
[Abstract]:Legal education is of great significance to the establishment of a society ruled by law. Therefore, the study of law education is of great value today. The legal education in the modern sense began to enlighten and was born from the late Qing Dynasty. It was gradually developed through the great adjustment and promotion of the Beijing government and the Nanjing national government, and then developed to the present situation after more than 30 years of reform and opening up. In the history of more than one hundred years, Nanjing National Government played an important role in the development of law education. On the one hand, the legal education is on the right track and perfect step by step at this stage, which has trained many legal talents, promoted the modernization of China's legal education and the construction of the rule of law, on the other hand, the legal education system of this period also has certain defects. It has important reference value for the present law education, and can provide abundant experience and enlightenment to promote the development and perfection of the law education nowadays. In order to deeply and comprehensively understand the whole picture of legal education in the period of Nanjing National Government, explore the characteristics of legal education at that time, and excavate its experience and enlightenment, this paper adopts various methods, such as comparative research, dynamic research, historical facts exposition and historical knowledge inquiry, etc. The article is divided into three parts: introduction, text and conclusion. The main body of the text contains four aspects: the birth of modern law education in the late Qing Dynasty and the early Republic of China, the establishment and implementation of the legal education thought of the Nanjing National Government, and the development and perfection of the legal education system of the Nanjing National Government. The characteristics and Enlightenment of legal Education in Nanjing National Government. The first part uses the dynamic method to sort out the historical process of the birth of the modern law education, reveals the background of the birth of the law education, and expounds the legal education system and its characteristics in the late Qing Dynasty and the early Republic of China. As the starting point of the legal education research of the Nanjing National Government, the two are compared simply at the same time. The second, third and fourth parts are the key points and core contents of the article, which mainly focus on the legal education in the period of Nanjing National Government. The second part mainly expounds the establishment of the legal education thought of the Nanjing National Government and the related policies and the implementation of the law, focusing on the difference between the modern and modern legal education thought and the Chinese traditional education thought. And analysis of the causes of this difference and the process of change. The third part is the historical description and historical evaluation of the legal education system, through the legal education management system, educational institutions, school form, school system, credit, curriculum, teachers, students and other aspects of the elaboration. Deeply understand and explore the situation of law education at that time, and analyze its internal logic. The fourth part summarizes and summarizes the legal education of the Nanjing National Government, summarizes its characteristics from the aspects of the thought and system of the legal education, and summarizes the experience and enlightenment of the legal education in China at that time. This paper probes into the dilemma and developing direction of the legal education in the modern sense of China.
