法治中国建设与“德法合治”的思想渊源

【摘要】：中华民族固有的精神传统与文化理念,是当代中国国家治理的基石。德治与法治是中华法文化的两大核心概念,也是诸子百家争辩执政理念的永恒主题,"德法合治"在我国具有深厚的历史底蕴与文化渊源。法律和道德在治国理政之中起到的作用是相辅相成、相得益彰的:法律通过条文规定体现道德理念;道德理念在实践中又是法治精神和法治文化的支撑。这种传统国家治理理念对于当代中国法治建设提供了一个良好的历史视角。在汲取优秀的传统文化的基础上,通过文化自信的历史建构与时代之思,推动依法治国和以德治国相结合,这是习近平新时代中国特色社会主义思想的重要组成部分。
[Abstract]:The spiritual tradition and cultural concept inherent in the Chinese nation are the cornerstone of contemporary Chinese national governance. Rule by virtue and rule by law are the two core concepts of Chinese legal culture, and they are also the eternal theme of the ruling concept of the hundred schools of thought. "Rule by virtue and law" has profound historical and cultural origins in our country. Law and morality play a complementary and complementary role in governing the country: the law embodies the moral idea through provisions, and the moral idea is the support of the spirit of the rule of law and the culture of the rule of law in practice. This traditional concept of state governance provides a good historical perspective for the construction of the rule of law in contemporary China. On the basis of absorbing the excellent traditional culture and through the historical construction of cultural self-confidence and the thought of the times, it is an important part of the socialist thought with Chinese characteristics in the new era of Xi Jinping to promote the combination of the rule of law and the rule of virtue.
