中国特色社会主义法治与社会治理的互动关系研究

【摘要】：中国特色社会主义法治与社会治理有着内在的联系和外在的契合。中国特色社会主义法治是社会治理的行为手段。完善社会主义法治建设决定了在本质上就是推进社会治理法治化。社会主义法治为社会治理注入良法,为善治提供依据,对社会治理的变革具有重要意义。法治化是社会治理发展的必经之路,从建设法治社会到建设法治国家,从法律之治到良法善治,这无一不指明着社会主义法治的前进方向。对中国特色社会主义法治与社会治理的互动关系探究,是对我国社会,对我国国情详细了解后的产物。社会治理就是要将公共利益最大化,社会治理主体采取制度化方式或者非制度化方式行使自己的权利,实现自己的利益。在法治国家背景下,社会主义法律规范是社会治理的重要基石,社会治理精神也与社会主义法治精神相吻合。社会主义法治是社会治理的基本形式,社会治理是国家治理的重要内容。推进国家治理现代化,就是要找到社会主义法治与社会治理的契合点,从而大力推行社会治理法治化进程。在中国特色社会主义法治与社会治理互动的过程中,必然存在相协调的地方,也存在对立的因素。但无论怎样,社会治理都要坚持依法治理,加强法治保障,运用法治思维和法治方式,在社会治理领域重视立法与制度建设,确保在法治轨道上加快社会治理建设。中华民族的繁荣、富强,很大程度上取决于我们是否有一个适合我国国情的法律制度体系,通过有效的法律制度来运行社会治理,维护社会的和谐、稳定,大力推行社会治理法治化,为实现社会长治久安提供保障。
[Abstract]:The rule of law of socialism with Chinese characteristics has internal relation and external agreement with social governance. Socialist rule of law with Chinese characteristics is a means of social governance. Perfecting the construction of socialist rule of law determines that in essence, it is to promote the rule of law of social governance. Socialist rule of law infuses good laws into social governance and provides basis for good governance, which is of great significance to the reform of social governance. The rule of law is the only way for the development of social governance, from the construction of a society ruled by law to the construction of a country ruled by law, from the rule of law to good governance of law, all of which indicate the direction of the socialist rule of law. The study of the interactive relationship between the rule of law and social governance of socialism with Chinese characteristics is the product of a detailed understanding of our society and our national conditions. Social governance is to maximize the public interests, the main body of social governance to take the institutionalized or non-institutionalized way to exercise their rights, to achieve their own interests. Under the background of a country ruled by law, the socialist legal norm is the important cornerstone of social governance, and the spirit of social governance is in line with the socialist spirit of ruling by law. Socialist rule of law is the basic form of social governance, social governance is an important content of national governance. To promote the modernization of state governance is to find out the joint point between socialist rule of law and social governance, so as to vigorously promote the process of social governance by law. In the course of the interaction between the rule of law and social governance of socialism with Chinese characteristics, there must be a harmonious place and antagonistic factors. But in any case, social governance should adhere to the rule of law, strengthen the protection of the rule of law, use the rule of law thinking and the rule of law, in the field of social governance attention to legislation and system construction, to ensure the rule of law track to speed up the construction of social governance. The prosperity, prosperity and strength of the Chinese nation depend to a large extent on whether we have a legal system suited to the national conditions of our country, to run social governance through an effective legal system and to maintain social harmony and stability. Vigorously promote social governance and rule by law, for the realization of long-term social stability to provide security.
