【摘要】：法治是治国理政的基本方式。党的十八大提出要全面推进依法治国,党的十八届四中全会首次以依法治国为主题,党的十八届六中全会提出统筹推进“五位一体”总体布局和协调推进“四个全面”战略布局,这些都体现出依法治国在我国的重要地位。社会主义法治国家的建设不光要有完备的法律体系,更要有高素养的法律职业队伍。法律人在这其中起着重要的作用,法律人的素质更是关键,相较于其他的法律素质来说,法律人的法律职业伦理更为重要。法律职业伦理是每个国家法律制度必不可少的构成因素,法律职业的成长、司法改革的完善、社会的进步都需要法律职业伦理。法学教育作为培养法律职业伦理的主要手段,是一国法律制度最基本的造型因素之一。本文旨在研究高校法学生法律职业伦理的培养情况。当前的法律实践折射出部分法律人的法律职业伦理的缺失,这在社会上产生了恶劣的影响。法学生是法律职业的主力军,他们的职业伦理影响着整个法律职业共同体的素质,发现法学生职业伦理培养中的不足,对其进行完善,塑造未来法律从业人员的高水平职业素质。文章分为四个部分。第一部分主要是概括论述高校法学生的法律职业伦理,界定清楚与之有关的种种概念,同时引出高校法学生的法律职业伦理现状以及培养的可行性,为下文论述做好准备。第二部分主要是指出目前我国法学院校法学生法律职业伦理存在的问题,进一步分析造成这些问题的原因。第三部分主要是分析国外高校对法律职业伦理的培养,借鉴国外先进的教育模式为我国高校提供可用的经验。最后一部分对如何培养法学生的法律职业伦理提出自己的一些看法,希望可以对法学院校职业伦理教育有启发、帮助作用。这一部分从三个方面来论述,宏观上如何加强法律职业伦理教育;微观上从具体教育的方面来进行完善法学生的培养;此外就是给法学生创造一定的氛围,更加利于法律职业伦理的塑造。文章重点分析当前高校法学生职业伦理培养中产生的问题及成因,比较国外法学院校关于法律职业伦理问题的研究,并借鉴其经验,综合归纳提出完善法学生的法律职业伦理的对策。
[Abstract]:The rule of law is the basic way of governing the country. At the 18th CPC National Congress, it was proposed that the rule of law should be comprehensively promoted. For the first time, the fourth Plenary session of the 18th CPC Central Committee focused on governing the country according to law. The sixth Plenary session of the 18th CPC Central Committee proposed that the overall layout of "five in one" and the strategic layout of "four all-round" should be promoted in a coordinated manner, which all reflect the important position of ruling the country according to law. The construction of a socialist country ruled by law requires not only a complete legal system, but also a highly educated legal profession. The legal person plays an important role in this process, and the quality of the legal person is even more crucial. Compared with other legal qualities, the legal professional ethics of the legal person is more important. Legal professional ethics is an essential component of every country's legal system. The growth of legal profession, the perfection of judicial reform and the progress of society all need legal professional ethics. Legal education is one of the most basic modeling factors of a country's legal system as the main means of cultivating legal professional ethics. The purpose of this paper is to study the cultivation of legal professional ethics for law students in colleges and universities. The current legal practice reflects the lack of legal professional ethics of some legal people, which has a bad influence on the society. Law students are the main force of the legal profession, their professional ethics affect the quality of the whole legal professional community. Shape the future of the legal profession's high level of professional quality. The article is divided into four parts. The first part is to generalize the legal professional ethics of law students in colleges and universities, define all kinds of concepts related to it clearly, and at the same time, draw the present situation of legal professional ethics of law students in colleges and universities as well as the feasibility of training, so as to prepare for the following discussion. The second part mainly points out the problems existing in the legal professional ethics of law students in law colleges and universities in our country, and further analyzes the causes of these problems. The third part mainly analyzes the cultivation of legal professional ethics in foreign colleges and universities, and provides the available experience for China's colleges and universities by drawing lessons from foreign advanced educational models. The last part puts forward some views on how to cultivate the law students' legal professional ethics, hoping that it can enlighten and help the professional ethics education in law colleges and universities. This part discusses from three aspects: how to strengthen legal professional ethics education macroscopically; how to improve the cultivation of law students from the specific aspects of education; in addition, to create a certain atmosphere for law students. More conducive to the shaping of legal professional ethics. This paper focuses on the analysis of the problems and causes in the training of professional ethics of law students in colleges and universities, compares the research on legal professional ethics in foreign law colleges and universities, and draws lessons from their experiences. A comprehensive summary of the improvement of the legal professional ethics of law students countermeasures.
