科技资源高效利用法律意识培育研究

【摘要】：现今,法律意识已成为衡量一国人民素质高低与否的重要标准,是法治国家的一项重要指标。科技创新需要科技资源的高效利用,科技资源利用法律规范和科技资源相关主体的高效利用法律意识直接影响科技资源效能的发挥和国家创新系统的建设,事关社会经济的发展。然而,我国科技资源相关主体的科技资源高效利用法律意识水平较低,科技资源高效利用法律意识培育体系不完善,严重制约着科技资源的利用率。本文以促进我国科技资源的高效利用为目标,主要采取文献研究法、问卷调查法、比较研究法等,按照“理论研究-问卷调查-现状分析-对策提出”的逻辑顺序展开研究。从现状到对策,针对科技资源高效利用效率低下及其法律意识薄弱的问题,主要围绕以下几个问题进行研究:(1)科技资源高效利用法律意识培育的主体与对象的角色厘清。(2)科技资源高效利用法律意识培育的主要内容。(3)科技资源高效利用法律意识培育的措施。本文从主体的思想层面和科技资源高效利用法律意识及其培育状况展开问卷调查。通过分析发现以下几点问题:第一,科技资源高效利用法律法规不健全,直接影响科技资源相关主体法律意识的形成。第二,科技资源相关政策法律法规宣传不到位,宣传渠道单一且不健全,导致科技资源相关主体对有关科技资源利用法律法规了解和掌握程度不够,相关法律知识水平偏低。第三,当前科技资源相关主体对资源需求迫切与科技资源利用率低下之间的矛盾凸显,科技资源相关主体对科技资源高效利用法律意识重视不够。为此,本文提出如下建议:首先明确培育主体与对象之间的角色转换,其次突出从原则和权利义务关系两个方面重点内容的学习掌握来培育科技资源高效利用相关法律意识,最后提出培育措施,从加强法律制度建设、培育体系构建、落实法律制度,将加强对法律意识的培育贯彻到制度实施的全过程中。立法不是目的,真正的目的是通过立法来调整法律关系,在法律实施过程中,培育人们自觉遵守的法律意识,内化为自身的理念,从而在实践中指导人们的行为。科技资源高效利用法律意识培育更要认清这一点,发挥法律意识对科技资源高效利用实践的促进作用。
[Abstract]:Nowadays, legal consciousness has become an important standard to measure the quality of a country's people and an important index of a country ruled by law. Scientific and technological innovation requires the efficient use of scientific and technological resources. The legal norms of the utilization of scientific and technological resources and the legal awareness of the efficient use of scientific and technological resources directly affect the effectiveness of scientific and technological resources and the construction of national innovation systems. It concerns the development of society and economy. However, the level of the legal awareness of the effective use of scientific and technological resources is low, and the cultivation system of the legal awareness of the efficient utilization of scientific and technological resources is not perfect, which seriously restricts the utilization rate of scientific and technological resources. The aim of this paper is to promote the efficient utilization of science and technology resources in our country. This paper mainly adopts the methods of literature research, questionnaire survey and comparative research, and carries out the research according to the logical sequence of "theoretical research, questionnaire survey, current situation analysis and countermeasures put forward". From the current situation to the countermeasures, aiming at the problems of inefficient utilization of scientific and technological resources and weak legal consciousness, This paper mainly focuses on the following questions: 1) the role of the subject and object in the cultivation of the legal awareness of the efficient use of scientific and technological resources. (2) the main content of the cultivation of the legal awareness of the efficient use of scientific and technological resources. 3) the method of efficient use of scientific and technological resources. Measures to cultivate legal consciousness. This paper carries out a questionnaire survey on the ideological level of the subject, the awareness of the efficient use of scientific and technological resources and its cultivation. The following problems are found through the analysis: first, the imperfect laws and regulations for the efficient use of scientific and technological resources directly affect the formation of the legal consciousness of the subjects concerned with the scientific and technological resources. Second, the science and technology resources related policies and laws and regulations propaganda is not in place, the propaganda channel is single and not perfect, leading to the science and technology resources related subject to the science and technology resources use laws and regulations understanding and mastery degree is not enough, the related legal knowledge level is on the low side. Thirdly, the contradiction between the urgent demand for scientific and technological resources and the low utilization rate of scientific and technological resources is highlighted, and insufficient attention is paid to the legal awareness of the efficient use of scientific and technological resources. For this reason, this paper puts forward the following suggestions: firstly, the role conversion between the subject and the object should be clearly defined, and secondly, the relevant legal awareness of the efficient use of scientific and technological resources should be cultivated by emphasizing the learning and mastering of the two key contents of principle and the relationship between rights and obligations. Finally, the author puts forward the cultivation measures, which will strengthen the cultivation of legal consciousness and carry out the whole process of system implementation from strengthening the construction of legal system, cultivating the construction of system and carrying out the legal system. Legislation is not an aim. The real purpose is to adjust the legal relationship through legislation. In the process of implementing the law, we should cultivate the legal consciousness that people consciously abide by, internalize it as their own idea, and guide people's behavior in practice. The cultivation of the legal consciousness of the efficient use of scientific and technological resources should recognize this point and give full play to the role of legal consciousness in promoting the efficient use of scientific and technological resources.
