美国的宠物狗管理法及其对中国的启示

【摘要】：美国宠物狗管理法围绕宠物狗饲养资格的取得、宠物狗的饲养方式、狗主人义务等方面对狗主人的饲养行为进行全方位的规制。除此之外,各州还依据其实际情况的不同,在制定宠物狗管理法中会有所不同。加利福尼亚州重视宠物狗数量,严格要求宠物狗做绝育手术。伊利诺伊州将宠物狗依危险程度的不同分为三类,饲养不同危险程度的宠物狗其狗主人的行为规范和注意事项会有不同。美国宠物狗管理法比较完善,其多样性对于我国城市饲养狗管理法体系的不断完善有极强的研究价值。本文对美国联邦及两个代表州的宠物狗管理法全面阐述和评析,对比分析我国北京、广州两个城市饲养犬类的管理规定。在此基础上,本文结合我国目前城市养狗的现状和出现的问题,从养狗人资格、狗主人行为规范和执法这三方面入手,提出了可行的借鉴。我国需要逐渐完善城市宠物狗登记制度,严格控制宠物狗的免疫和数量,并对禁养犬的范围做出明确规定,细致的规范狗主人的日常饲养行为;同时加强有关部门的执法能力。
[Abstract]:American pet dog management law focuses on the acquisition of pet dog breeding qualifications, pet dog breeding methods, dog owners obligations and other aspects of the dog owners to conduct comprehensive regulation of the breeding behavior. In addition, states will vary in the development of dog management laws, depending on their actual circumstances. California values the number of dogs and requires them to be sterilized. In Illinois, dogs are classified into three categories according to their risk levels, and the behavior and precautions of dog owners are different for dogs with different risk levels. The American pet dog management method is relatively perfect, its diversity has the extremely strong research value to our country city raising dog management system unceasingly consummation. In this paper, the canine management laws of the United States and two representative states are comprehensively expounded and analyzed, and the regulations on canine breeding in two cities of Beijing and Guangzhou in China are compared and analyzed. On this basis, combining the current situation and problems of dog keeping in cities in our country, this paper puts forward the feasible reference from the aspects of dog owner qualification, dog owner behavior standard and law enforcement. China needs to gradually improve the urban dog registration system, strictly control the immunization and number of dogs, and make clear provisions on the scope of prohibited dogs, meticulously regulate the daily breeding behavior of dog owners; at the same time, strengthen the law enforcement capacity of relevant departments.
