【摘要】：正[编者按]近十几年来,中国法学研究不同进路之间的分化理路逐渐清晰,其中倡导面向中国社会实际、通过运用社会科学方法研究法律现象和法治问题的社科法学研究日渐兴起,这方面的研究成果越来越丰富。不过,纵观已有的关于社科法学的研究成果不难发现,学者们多集中于研究方法、实践案例等具体问题的论述,而不注重社科法学一般性问题的讨论。例如,当法经济学分析、法社会学研究、法人类学路径等都被囊括在社科法学"旗下"的时候,社科法学的内涵和边界究竟在哪里?社科法学究竟是一种什么样
[Abstract]:In the past decade or so, the differentiation between different approaches in Chinese legal research has gradually become clear, in which it is advocated to face the reality of Chinese society. Through the use of social science methods to study legal phenomena and the rule of law, the study of social science law is on the rise, and the research results in this field are more and more abundant. However, it is not difficult to find that scholars focus on the discussion of specific problems such as research methods, practical cases and so on, rather than the discussion of general problems of social science law. For example, when the analysis of law and economics, the study of sociology of law and the path of legal anthropology are all included in the "subordinate" of social science law, where is the connotation and boundary of social science law?
