【摘要】：《唐律疏议》是唐代的刑法典,是中国现存最早、最完整、也是中华法系最具代表性的封建法典,由律文(含注文)及律疏组成,律疏对律文及注文逐句逐条进行立法解释与司法解释,这种解释属有权解释,即律疏与律条具有同等的法律效力。《唐律疏议》法律解释的基本手段为训诂,因此在语言学、汉语史领域有重要的研究价值。《唐律疏议》主要的律学训诂方式之一为法律问答体,以“问曰”、“答曰”的形式虚拟对话,预设司法实践中的疑难案例,并给以详尽解析,这种问答体疏证共出现178处。本文首先对问答体疏证问式与答式的语篇结构、问答的会话合作原则与会话结构进行分析,并将重点放在问答体疏证训诂特点的研究上,从微观角度深入问答体疏证内部,探讨其训释内容、训释程式、方法、用语等,归纳特点,总结规律。
[Abstract]:"Tang law" is the penal code of the Tang Dynasty. It is the earliest, most complete and most representative of the feudal code in China. It is composed of law text (including annotation) and law. It is the legal interpretation and judicial interpretation of law text and sentence by sentence. This interpretation belongs to the right explanation, that is, the law has the same legal effect as the law. The basic means of legal interpretation is exegesis. Therefore, it has important research value in the field of linguistics and the history of Chinese. One of the main methods of exegesis of the law of Tang law is the legal question and answer style, with the form of "say", "answer" in the form of virtual dialogue, a difficult case in judicial practice, and a detailed analysis, such a question and answer body. In this paper, there are 178 parts in this paper. Firstly, this paper analyzes the discourse structure of question and answer style and question and answer style, the principle of dialogue cooperation and conversation structure in question and answer, and puts emphasis on the study of the characteristics of quiz, and discusses the contents, procedures, methods and expressions from the microcosmic point of view.
