康熙朝《刑部现行则例》的修颁时间、传本及特色

【摘要】：清代官方文献对康熙朝《刑部现行则例》的完成和颁布时间记载并不清晰,甚至存在颇多差谬,康熙十九年四月癸酉日的这则记载应是误记,康熙朝《刑部现行则例》的奉旨颁布日期应该是康熙十九年四月二十七日。沈家本点校的传本内容也有错误之处,应根据"上谕"等史料推断其准确内容;《刑部现行则例》的修订具有其自身的特色,如立法技术概括性不强、行政指令色彩极浓、保留了比较鲜明的满洲特色或边域文化特征等,这些特征反映了康熙朝法例的行文习惯与民族情结。
[Abstract]:The official documents of the Qing Dynasty did not clearly record the completion and promulgation of the current rules of punishment of the Kangxi Dynasty, and there were even many errors. This record of April and Sebacu Day of Kangxi should be a mistake. The date of promulgation of the current Code of Criminal Law of the Kangxi Dynasty should be April 27, 1999. There are also errors in the content of the biography of Shen Jiaben School, which should be inferred from historical materials such as the "Shang qu". The revision of the current rules of Criminal Affairs has its own characteristics, such as the lack of generality of legislative techniques and the extremely strong color of administrative instructions. The characteristics of Manchuria or frontier culture reflect the writing habits and national complex of Kangxi Dynasty.
