《济贫法》到《国民保险法》：英国社会法兴起

【摘要】：英国是世界社会法兴起较早的国家之一,从《济贫法》到《国民保险法》,英国社会法兴起的脉络清晰,每一步的发展历程都具有其历史时代性的特点,原创性强,经验及原理值得借鉴。本文首先以《济贫法》到《国民保险法》为线索进行梳理,以观察者的视角尽可能复原这一历史时期英国社会法兴起的原貌;其次,进一步考察了从《济贫法》到《国民保险法》,影响英国社会法兴起的因素,主要从背景、政府、思想三个方面展开探析。再次,在梳理英国社会法兴起的状况、考察英国社会法兴起影响因素的同时,对英国社会法兴起进行简要概括分析其特点,最后展开经验总结与启示借鉴与挖掘。
[Abstract]:Britain is one of the countries with the early rise of social law in the world. From the Law of Poverty Relief to the Law of National Insurance, the context of the rise of British social law is clear, and the development of each step has its historical characteristics and originality. Experience and principle are worth drawing lessons from. In this paper, the author first combs the clue from the Law of Alleviation to the Law of National Insurance to restore as far as possible the original appearance of the rise of English social law in this historical period from the perspective of the observer. This paper further examines the factors that influence the rise of British social law from the Law of Poverty Relief to the Law of National Insurance, mainly from three aspects: background, government and thought. Thirdly, after combing the situation of the rise of English social law and investigating the influencing factors of the rise of British social law, the author briefly analyzes its characteristics, and finally carries out the experience summary, inspiration and excavation.
