古代蒙古人的犯罪观与刑罚文化

【摘要】：蒙古人的矛盾性格在其习俗与法律中体现为内外有别的二元犯罪观与相对宽和的刑罚文化。当时的蒙古各部落内部因"约孙"的调整而相对稳定,却因为部落间的仇恨和争夺而连年混战,与其二元犯罪观有关。蒙古人的刑罚从帝国前期的极端严苛发展到北元时期日益表现出的轻缓。这一变迁与蒙古王公贵族的治理术以及国家观念的瓦解有很大的关联。
[Abstract]:The contradictory character of the Mongols is embodied in their customs and laws as a dual view of crime and a relatively lenient penalty culture. At that time, the Mongolian tribes were relatively stable because of the adjustment of "Joson", but they fought for years because of hatred and contention between tribes, which was related to their dual view of crime. The penalty of Mongols developed from extreme severity in the early period of the empire to the light and gentle gradually in the Northern Yuan Dynasty. This change is closely related to the governance of the Mongol princes and the disintegration of the concept of state.
