中、英两国法学本科专业课程设置比较研究

【摘要】:教育的本质是提高人的素质,而课程设置是为教育服务的。只有个体得到发展,社会才能进步,国家才能强大。随着法律职业的全球化进程加快和信息网络化发展,对我国法学教育的改革、发展提出了新的要求和挑战。尽管我国的高等法学教育不断发展,法学教育体系不断完善,培养了一大批优秀的法律人才,但法学教育起步较晚,有许多不足之处,课程设置有待于进一步完善。 英国法律起源较早,在两千多年的发展进程中,积累了丰富的经验,其法学教育也自成体系。尽管中英分属不同的法系,英国法学教育在很多方面其中较之合理的课程设置仍值得我们借鉴和思考。 本研究从中英法学教育课程改革发展历史沿革入手,在通过对中英两国法学本科专业课程设置现状与特征描述的基础上,,进行中英两国法学本科专业课程设置的课程设置目标、课程设置结构、课程设置内容以及课程设置的权力等方面进行比较,进而得出我国政法学院法学本科专业需统一培养目标与课程设置目标、优化课程结构设置、更新课程设置内容、放宽课程设置的权利、加强实践环节,以更好地促进我国法学教育的健康发展。
[Abstract]:The essence of education is to improve the quality of people, and the curriculum is for the service of education. Only when the individual develops can the society progress and the country strong. With the acceleration of the globalization of legal profession and the development of information network, new requirements and challenges have been put forward for the reform and development of legal education in China. Although the higher law education in our country has been developing continuously, the legal education system has been continuously improved, and a large number of outstanding legal talents have been trained, but the law education started late, there are many deficiencies, and the curriculum needs to be further improved. English law originated early and accumulated rich experience in the course of development for more than two thousand years, and its legal education also formed its own system. Although China and Britain belong to different legal systems, English law education in many aspects is more reasonable than the curriculum is still worthy of our reference and reflection. This study starts with the history of law education curriculum reform in China and Britain, and on the basis of describing the present situation and characteristics of the undergraduate law curriculum in China and the United Kingdom, carries on the curriculum setting objectives of the law undergraduate courses in China and Britain. By comparing the structure of curriculum, the content of curriculum and the power of curriculum, the author draws a conclusion that the undergraduate law major of political Science and Law College of our country should unify the training goal with the course setting target, and optimize the course structure. In order to promote the healthy development of law education in our country, we should renew the content of curriculum, relax the right of curriculum setting and strengthen the practice link.
