网络舆情与公正执法之良性互动研究

【摘要】：近年来，随着网络舆论的壮大和网络媒体的不断发展，网络舆情覆盖面不断扩大，对公正执法的影响力日趋扩张。网络舆情在主体、客体、载体、本体方面的特征与执法活动的主体、客体及职能特征相互碰撞，二者之间的主体差异性、内容关联性、职能耦合性等关系，为网络舆情与公正执法之间互动的可能性提供了现实基础。频繁发生的“开胸验肺”、“钓鱼执法”、“周老虎”、“天价烟”、“微博打拐”等涉及执法的公共舆情事件，一方面彰显出网络舆情对公正执法的推动作用，不但有利于揭露我国执法过程中存在的问题，监督执法活动，而且为执法活动提供了网络反腐、网络问政等适应社会发展的新型执法思路，创新执法形式；另一方面，网络舆情现象中的人肉搜索、网络调查等行为也存在破坏网络法治环境的负面影响。随着网络舆情影响力不断增强，舆情对“媒治”的呼声渐高。通过对网络舆情现象的深层剖析，推知网络舆情作为一种社会监督力量，依然是法治不可或缺的构成性机制，，但其“媒治”效应只是权利对权力行使监督作用的彰显。网络舆情现象体现出社会公众对于自由、平等、公正的深切渴望，凸显了社会对法治的深度诉求，为网络舆情与公正执法之间互动的必要性提供了现实依据。网络舆情与公正执法作为法律运行的重要环节，在处理二者关系时，要坚持立足法治，严格规范执法，完善法律监督体系，推进公正执法实效；利用网络推进信息公开制度，化“媒治”力量为法治所用，保障执法透明；建立网络舆情应对机制，以制度消解网络舆情的负面影响，推进新媒体时代法治化建设，促成法治社会的良性运转。
[Abstract]:In recent years, with the expansion of network public opinion and the continuous development of network media, the coverage of network public opinion is expanding, and the influence on fair law enforcement is expanding day by day. The characteristics of network public opinion in the aspects of subject, object, carrier and ontology collide with the subject, object and function characteristics of law enforcement activities. It provides a realistic basis for the possibility of interaction between network public opinion and impartial law enforcement. The frequent public opinion incidents involving "chest examination", "fishing enforcement", "Zhou tiger", "sky-high smoke", "Weibo trafficking" and so on, on the one hand, highlight the role of network public opinion in promoting fair law enforcement. It is not only conducive to exposing the problems existing in the course of law enforcement in our country and supervising law enforcement activities, but also providing new law enforcement ideas and innovative forms of law enforcement that are adapted to the development of society, such as network anti-corruption, network administration, and so on; on the other hand, The human flesh search and network investigation in the phenomenon of network public opinion also have the negative influence to destroy the environment of network rule of law. With the increasing influence of network public opinion, the voice of public opinion to "media governance" is increasing. Through the deep analysis of the phenomenon of network public opinion, it is inferred that network public opinion, as a kind of social supervision power, is still an indispensable constitutive mechanism of the rule of law, but its "medium governance" effect is only the manifestation of the right's supervisory function on the exercise of power. The phenomenon of network public opinion reflects the deep desire of the public for freedom, equality and justice, highlights the deep demand of society for the rule of law, and provides a realistic basis for the necessity of interaction between network public opinion and impartial law enforcement. Network public opinion and impartial law enforcement are important links in the operation of law. When dealing with the relationship between them, we should stick to the rule of law, strictly standardize law enforcement, perfect the legal supervision system, promote the effectiveness of fair law enforcement, and use the network to promote the information disclosure system. The power of "media governance" is used for the rule of law to ensure the transparency of law enforcement, to establish a mechanism to deal with network public opinion, to eliminate the negative influence of network public opinion by system, to promote the construction of the rule of law in the new media era, and to promote the benign operation of the society ruled by law.
