论我国传统法律文化对和谐社会建设的意义

【摘要】：改革开放以来,我国的经济建设取得了巨大的成就,法治建设也取得了长足的进步。但社会上仍旧存在很多不稳定,不和谐的因素;部分改革中的遗留问题没有解决,发展中的新问题又逐渐显现出来。此时党中央正式提出了“构建社会主义和谐社会”的理念,这是及时而正确的。作为中国传统法律文化中独具特色的一个组成部分,“和谐”历来是人们孜孜追求的社会理想,是中华民族传统文化的宝贵遗产。传统社会中和谐的理念及其制度实践,经过数千年的缓慢演进与完善,已经深深植根于古代政治制度与社会生活的土壤中了。通过挖掘传统法文化中的和谐价值理念及法律实践精华,寻找这种理念的合理内涵,考察古代社会长治久安的原因,探寻法治发展的传统动力,必然有助于转型期中国立法与司法的完善,为构建和谐社会提供保障和借鉴。本文从和谐社会建设的视角对传统法律文化进行考察,试图通过发掘其中的和谐因素为今日的社会建设提供借鉴。本文第一部分对传统法律文化的涵义进行了分析,试着对其中蕴含的和谐价值进行阐释。第二部分论述了和谐社会建设需要与之相适应的法律文化支撑,需要法律文化的保障。第三部分主要介绍了传统法律文化对和谐社会的启示和价值,从思想和制度两个方面进行了分析。第四部分介绍了传统法律文化可以借鉴的传统资源,怎样和现代社会治理相结合等。
[Abstract]:Since the reform and opening up, China's economic construction has made great achievements, the construction of the rule of law has also made considerable progress. However, there are still many unstable and disharmonious factors in society; some of the problems left over in the reform have not been solved, and new problems in development are gradually emerging. At this time, the CPC Central Committee formally put forward the concept of "building a socialist harmonious society", which is timely and correct. As a unique part of Chinese traditional legal culture, "harmony" has always been a social ideal pursued by people and a precious heritage of Chinese traditional culture. The idea of harmony in traditional society and its practice have been deeply rooted in the soil of ancient political system and social life after thousands of years of slow evolution and perfection. Through excavating the harmonious value idea and the essence of legal practice in the traditional law culture, the reasonable connotation of this idea is sought, the reason of the ancient society's lasting stability is investigated, and the traditional motive force of the development of the rule of law is explored. It will certainly help to perfect the legislation and judicature of China in the transition period and provide protection and reference for the construction of a harmonious society. This paper investigates the traditional legal culture from the perspective of the construction of a harmonious society, and tries to provide reference for the construction of today's society by exploring the harmonious factors. The first part of this paper analyzes the meaning of traditional legal culture and tries to explain the harmonious value. The second part discusses that the construction of harmonious society needs the support of legal culture and the guarantee of legal culture. The third part mainly introduces the enlightenment and value of the traditional legal culture to the harmonious society. The fourth part introduces the traditional resources which can be used for reference by the traditional legal culture, how to combine with the modern social governance and so on.
