【摘要】：法律体系对于法治建设而言具有基础性作用。一个国家法律体系的形成必然是该国法治实践的产物,与一定历史条件和时代背景是分不开的。中国特色社会主义法律体系是在建国以来我国社会主义民主法治建设的过程中逐步形成起来的。法治建设过程中,从最初强调加强社会主义民主法治建设到依法治国、建设社会主义法治国家的基本方略的确立再到全面落实依法治国基本方略、加快建设社会主义法治国家要求的提出,始终有一个重大问题贯穿其间,就是如何建构和完善中国特色社会主义法律体系。站在新的时代背景下,党的十八届四中全会通过的《中共中央关于全面推进依法治国若干重大问题的决定》中明确提出,全面推进依法治国总目标,对以宪法为核心的中国特色社会主义法律体系的完善工作提出明确要求。因此,深入研究法律体系形成的理论基础、历史流变,总结中国特色社会主义法律体系的基本经验,对于探讨进一步完善中国特色社会主义法律体系这一重要命题,具有重要的理论价值和实践意义。论文主要包括中国特色社会主义法律体系形成的理论基础、历史流变以及经验总结三部分内容。第一部分,分析中国特色社会主义法律体系形成的理论基础。理论指导实践,并通过实践而自我完善。通过马克思主义经典作家的法律思想更好地掌握社会主义法律的根本规律及其本质,能够深入地把握中国化的马克思主义法律思想的性质和渊源。中国化的马克思主义法律思想是在马克思主义法律思想和法学理论的指导下,结合我国基本国情和发展需要而形成的。中国化的马克思主义法律思想始终指导着我国法律体系不断向着科学的方向发展。第二部分,中国特色社会主义法律体系的形成历程。将法律体系的形成历程大致分为探索、起步、形成三个阶段,对各个阶段法律体系形成的背景、过程以及该阶段的法律体系的特征和内容进行梳理和评析,为下一步总结法律体系形成的经验奠定基础。第三部分,对中国特色社会主义法律体系形成的经验进行总结。中国特色社会主义法律体系是在中国化的马克思主义法律思想指导下形成的,并随着中国化的马克思主义法律思想的丰富和发展而逐渐完善。对中国特色社会主义法律体系形成的经验进行总结,其实质是中国化的马克思主义法律思想这一理论向度与法律体系完善这一实践向度的坚守与开拓。
[Abstract]:The legal system plays a fundamental role in the construction of the rule of law. The formation of a country's legal system is bound to be the product of the country's legal practice, which is inseparable from certain historical conditions and the background of the times. The legal system of socialism with Chinese characteristics has been gradually formed in the course of the construction of socialist democracy and rule of law since the founding of the people's Republic of China. In the process of building the rule of law, from the initial emphasis on strengthening the construction of socialist democracy and the rule of law to the rule of law, the establishment of the basic strategy of building a socialist country ruled by law, and then to the comprehensive implementation of the basic strategy of governing the country according to law. In order to speed up the construction of a socialist country ruled by law, there is always a major problem running through it, that is, how to construct and perfect the legal system of socialism with Chinese characteristics. Standing against the background of the new era, the "decision of the CPC Central Committee on comprehensively promoting the Rule of Law on several important issues" adopted by the fourth Plenary session of the 18th CPC Central Committee clearly puts forward the general goal of comprehensively promoting the rule of law. To the constitution as the core of the socialist legal system with Chinese characteristics to improve the work put forward a clear request. Therefore, a thorough study of the theoretical basis and historical evolution of the formation of the legal system, and a summary of the basic experience of the legal system of socialism with Chinese characteristics, is an important proposition for exploring the further improvement of the legal system of socialism with Chinese characteristics. It has important theoretical value and practical significance. The thesis mainly includes three parts: the theoretical basis, the historical evolution and the experience summary of the formation of the socialist legal system with Chinese characteristics. The first part analyzes the theoretical basis of the formation of socialist legal system with Chinese characteristics. Theory guides practice, and self-perfection through practice. Through the legal thought of the classical Marxist writers, we can better grasp the fundamental law and its essence of socialist law, and can deeply grasp the nature and origin of the Marxist legal thought of Sinicization. The Sinicized Marxist legal thought is formed under the guidance of Marxist legal thought and legal theory, combined with the basic national conditions and development needs of our country. Chinese Marxist legal thought has always guided the development of Chinese legal system in the direction of science. The second part, the formation of the socialist legal system with Chinese characteristics. The forming process of legal system is divided into three stages: exploring, starting and forming. The background, the process and the characteristics and contents of the legal system in each stage are analyzed and analyzed. It lays a foundation for summing up the experience of the formation of the legal system in the next step. The third part summarizes the experience of the formation of socialist legal system with Chinese characteristics. The legal system of socialism with Chinese characteristics was formed under the guidance of Chinese Marxist legal thought, and gradually perfected with the enrichment and development of Chinese Marxist legal thought. Summing up the experience of the formation of the legal system of socialism with Chinese characteristics, its essence is the adherence and development of the theoretical direction of the Marxist legal thought of Chinese characteristics and the direction of perfection of the legal system.
