欧盟反垄断罚款决定的司法审查问题研究——基于对90余起欧盟判例的考察

【摘要】:随着我国反垄断处罚争议的逐渐显现,有关反垄断罚款决定的司法审查问题迫切需要关注。依据我国现行立法,法院有权对明显不当的反垄断罚款决定予以撤销或变更,但相关审查标准和强度并不明确。基于欧盟对我国反垄断法的体系性影响和我国对大陆法系行政法传统的因袭相承,其经验可资借鉴。制度上,欧盟法院对反垄断罚款决定享有不受限制的审查权,可以取消、减少或增加罚款数额。实践中,法院对这一权力的行使经历了强力审查—相对宽松—再度收紧的大体趋势。我国应严格审查反垄断罚款决定,同时当涉及确定罚款的相关指南时,法院应在确认指南合法性的基础上审查罚款决定对指南的适用是否合法,但在有正当理由的情形下,法院也可在个案中对指南有所偏离。
[Abstract]:With the emergence of disputes on antitrust penalty in China, the judicial review of antitrust penalty decision needs to be paid more and more attention. According to the current legislation of our country, the court has the power to revoke or change the obviously improper decision of antitrust penalty, but the relevant standards and intensity of examination are not clear. Based on the systematic influence of EU on China's antimonopoly law and the inheritance of administrative law tradition in civil law system, its experience can be used for reference. Institutionally, EU courts have unlimited review of antitrust fines, and may cancel, reduce or increase the amount of fines. In practice, the court's exercise of this power has undergone a general trend of intense-relatively lenient-retightening. China should strictly review the decision on antitrust fines, and when it comes to the relevant guidelines for the determination of fines, the courts shall, on the basis of confirming the legality of the guidelines, examine whether the application of the decision to the guidelines is lawful, but in cases where there are valid reasons, Courts may also deviate from the guidelines in individual cases.
