美国早期中立评估制度的探析与借鉴

【摘要】：近几年,随着大众法律意识的提高、权利意识的增强,我国逐渐进入了“诉讼高发期”。自2009年始,全国法院积极推进诉前调解,探索诉前纠纷解决的新途径,但由于各种因素的制约,诉前调解并不能像美国的替代性纠纷解决机制ADR(alternative dispute resolution)那般灵活有效。本文将结合笔者在法院从事诉前调解的实际工作经验,分析我国目前诉调机制存在的主要缺陷。笔者认为,要使诉前调解获得更高的效益、更好的社会效果,应当引入美国ADR中比较适宜我国法院现状的机制。本文以美国ADR的早期中立评估ENE(early neutral evaluation)作为切入点,介绍该机制的主要内容、特点、弊端、可移植性,针对我国诉前调解不尽人意的实际状况,为现有条件下的中国的诉前调解构建早期中立评估机制的基本框架。
[Abstract]:In recent years, with the improvement of public legal consciousness and the enhancement of the awareness of rights, China has gradually entered a period of "high incidence of litigation". Since 2009, the national court has actively promoted pre litigation mediation to explore new ways to resolve disputes before litigation. However, due to various factors, the pre lawsuit mediation can not be like the alternative dispute settlement mechanism ADR (alterna Tive dispute resolution) is so flexible and effective. This article will combine the actual working experience of the author's mediation before the court, and analyze the main defects in our current mechanism of mediation. The author thinks that it should be more suitable for the present situation of our court to make the pre lawsuit mediation more effective and better social effect. Based on the early neutrality assessment of ENE (early neutral evaluation) of American ADR as a breakthrough point, this paper introduces the main contents, characteristics, malpractices, portability of the mechanism, and the basic framework for the establishment of an early neutral assessment mechanism for China's pre lawsuit mediation under the existing conditions.
