蒙古族古代独特刑罚制—罚畜刑研究

【摘要】：罚畜刑是古代蒙古法律制度中一种独特的刑罚方式,以处罚犯罪者一定数量牲畜为定罪量刑规则的法律规定。罚畜刑经历了近千年的发展与演变,已成为蒙古法制史中一个重要的刑罚制度,该刑罚方式一经出现则适用于蒙古社会生活生产的各种违法犯罪行为当中,成为独特的一种刑罚制度。研究蒙古族古代罚畜刑,不仅能揭示古代蒙古族刑罚制度中罚畜刑的基本规律,还可以借鉴于当今刑罚制度财产刑的适用,具有一定的理论意义和现实价值。 本文章由引言、正文、结语三部分组成,其中正文分三部分。第一部分介绍了罚畜刑的发展演变过程。第二部分是罚畜刑的基本内容、适用范围及原因。第三部分是罚畜刑的特点及意义。
[Abstract]:Animal penalty is a unique punishment method in ancient Mongolian legal system. After nearly a thousand years of development and evolution, the punishment of livestock has become an important penalty system in the history of Mongolian legal system. Once it appears, it is applicable to all kinds of illegal and criminal acts produced in Mongolian society. Become a unique penalty system. The study of ancient Mongolian animal punishment can not only reveal the basic law of animal punishment in the ancient Mongolian penalty system, but also draw lessons from the application of property penalty in the present penalty system, which has certain theoretical significance and practical value. This article consists of three parts: introduction, text and conclusion, in which the text is divided into three parts. The first part introduces the development and evolution of the punishment of livestock. The second part is the basic content, the scope of application and the reasons. The third part is the characteristics and significance of animal punishment.
