经年之后,平等仍未实现——公民权、自主权与性别权利之辩

【摘要】：尽管争取性别平等、反对权力分配中的性别歧视已经40多年,但植根于社会、意识形态、制度结构包括法律中的性别依附和男性主宰的政治仍然存在。为什么这么多年来,经过平等理论的建构、辩论和行动计划的实施,实现性别平等仍然是如此的虚幻呢?部分的原因就在于现行的争取性别平等的斗争受到前人形成和传承的哲学、法理观念的束缚。本文提出了一个更实际的实现性别平等的办法,即跳出性别,在人性普遍的脆弱性上建立一个更广泛的框架。这种新的理论研究聚焦于特权和歧视,考察社会组织和制度结构在利益分配中的影响。这种方法可促使我们在美国社会中更好地获得实质的平等权和社会权利。
[Abstract]:Despite the struggle for gender equality and opposition to sexism in the distribution of power for more than 40 years, social, ideological, institutional structures, including gender dependence in the law and male-dominated politics, still exist. Why has the realization of gender equality been so illusory over the years through the construction of equality theories, debate and implementation of action plans? Part of the reason is that the current struggle for gender equality is bound by the philosophy and jurisprudence of the predecessors. This paper proposes a more practical approach to achieving gender equality, that is, to move beyond gender and to establish a broader framework for the universal vulnerability of human nature. This new theoretical study focuses on privilege and discrimination and examines the influence of social organization and institutional structure on the distribution of benefits. This approach will enable us to better achieve substantive equality and social rights in American society.
