论法律视域下社会公权力的内涵、构成及价值

【摘要】：社会公权力乃公共权力之分支,与国家公权力相对应;其发端于社会内部治理,是社会自治权的表征。政社分开与促进社会组织建设是国家对公共治理提出的新命题,在国家与社会二元界分、政府与社会合作治理的新时代,社会公权力已然以一种新的权力形态凸显于政治舞台。该权力的运行与组织建构等均与国家公权力有着迥然不同的规则抑或规律;在自治与规制的良性和谐之间,在权力与权利的有效互动之中,社会公权力与国家公权力一道演绎着多元民主与共建共治的新篇章。
[Abstract]:Social public power is a branch of public power, corresponding to the public power of the state; it originates in the internal governance of society and is the symbol of social autonomy. The separation of government and society and the promotion of social organization construction is a new proposition put forward by the state for public governance. In the new era of government and social cooperation and governance, the public power of society has been highlighted on the political stage with a new form of power. The operation and organizational construction of the power have different rules or laws from the public power of the state, and between the benign harmony of autonomy and regulation, the effective interaction between the power and the right. Social public power and state public power together deduce a new chapter of pluralistic democracy and co-establishment and co-governance.
