民国广东政府对商标的管理(1923-1936)

【摘要】:民国以来广东的政治环境尤为复杂,政治环境影响经济发展,使得广东商标的官方管理表现得错综复杂。自1923年,大本营政府成立,颁布商标法规,设有专门商标管理机构,广东商标始有正规的官方管理,且亦为自行管理的开始。1925年,广州国民政府成立后,商标先后由广东省商务厅、实业厅、建设厅管理,至1929年7月,广东商标管理权短暂统一于中央。1931年,陈济棠等公开反蒋,此后广东与南京政府保持着独立或半独立状态,此种政治态势具体映射到商标管理上,就是广东商标在南京政府大的商标管理架构下,保持自行管理。至1936年,广东归政中央,商标管理权最终统一于中央。本文对广东商标的官方管理分为两个时间段来进行探析,一是大本营时期至广州国民政府时期,即为广东革命政府时期;二是南京国民政府成立后至1936年广东归政中央,即为宁粤对峙时期。前一时期,重在阐述此一时期广东商标官方管理的架构,及政府如何管理商标;后一时期,重在阐述宁粤之间就广东商标管理权进行博弈及获得商标管理权方的应对方案。通过对以上两个时期的分析,对1923-1936年广东商标的官方管理的作用和意义,,给出客观评价。而商标管理权统一是顺应经济发展规律的,故广东商标管理权最终统一于南京政府,是历史的进步。
[Abstract]:Since the Republic of China, Guangdong's political environment is particularly complex, which affects economic development and makes the official management of Guangdong trademark complex. Since 1923, the local government established, promulgated trademark laws and regulations, set up a special trademark management agency, Guangdong trademark has formal official management, and also the beginning of self-management. 1925, after the establishment of the Guangzhou National Government, The trademark was managed successively by the Guangdong Commercial Department, the Industrial Department, and the Construction Department. In July 1929, Guangdong's trademark management authority was briefly unified in the central government. In 1931, Chen Jitang and others openly opposed Chiang. Since then, Guangdong and the Nanjing government have maintained an independent or semi-independent state. This kind of political situation concretely maps to the trademark management, that is, Guangdong trademark maintains its own management under the big trademark management structure of Nanjing government. In 1936, Guangdong returned to the central government, trademark management power was finally unified in the central. In this paper, the official management of Guangdong trademark is divided into two periods, one is the period from the base camp to the Guangzhou National Government, that is, the period of the Guangdong Revolutionary Government, the other is the period from the establishment of the Nanjing National Government to the return of the Guangdong Central Government in 1936. It is the period of confrontation between Nanjing and Guangdong. In the previous period, the framework of Guangdong trademark official management and how the government managed the trademark were expounded. In the latter period, the game between Nanjing and Guangdong on the Guangdong trademark management right and the solution to obtain the trademark management right were discussed. Through the analysis of the above two periods, this paper gives an objective evaluation on the role and significance of the official management of Guangdong trademarks from 1923 to 1936. The unification of trademark management power conforms to the law of economic development, so it is a historical progress that Guangdong trademark management power is finally unified in Nanjing government.
