俄罗斯反垄断法探究

【摘要】：作为苏联解体后的俄罗斯,其经过70年的计划经济的变革,有着大规模的产业基础,是典型的转型国家。在确立向社会主义市场经济体制转变过程中,反垄断法发挥了非常重要的作用。如何在经济转变过程中推行反垄断政策,规制反垄断行为,建立良好的市场竞争秩序等问题都十分值得研究。 俄罗斯的反垄断法自1991年颁布以来,已经走过21个年头,期间经过数次的改革和完善,它的体系已经逐渐成熟,有些规定甚至堪称先进,它对俄罗斯经济发展的指导意义也不可小觑。在规制反垄断的同时,俄罗斯也倡导文明竞争,只有这样才能既保证市场经济的繁荣发展,也保护了消费者的利益。 我国与俄罗斯同是发展中国家,在体制上有许多相似之处,如何处理好在转型过程中,既能够保持社会稳定,又可以促使经济自由高速的发展的问题上,俄罗斯的反垄断法中很多做法对我国来说有很好的借鉴意义。
[Abstract]:After the disintegration of the Soviet Union, Russia, after 70 years of planned economy reform, has a large-scale industrial basis, is a typical transition country. The anti-monopoly law has played a very important role in the process of establishing the socialist market economy system. It is worth studying how to carry out anti-monopoly policy, regulate anti-monopoly behavior and establish a good market competition order in the process of economic transformation. Russia's anti-monopoly law has gone through 21 years since it was promulgated in 1991, during which time it has been reformed and perfected several times. Its system has gradually matured, and some of its provisions are even more advanced. Its guiding significance to Russia's economic development should not be underestimated. While regulating antitrust, Russia also advocates civilized competition, which can not only guarantee the prosperity of market economy, but also protect the interests of consumers. China and Russia are both developing countries, and there are many similarities in the system. How to properly handle the problem of maintaining social stability and promoting the rapid development of economic freedom in the process of transformation? Russia's anti-monopoly law in a lot of practices for our country has a good reference.
