论表达自由的保障和限制

【摘要】：表达自由是民主政治的基石,也是公民的基本权利,对人类社会的发展和进步具有极其重要的意义和价值。简言之,表达自由就是人们通过语言文字来表达自己的思想和意识,公民可以借助表达自由权来表达对社会的不满和抨击时弊,也只有在表达自己的思想之后,这些思想才有可能被采纳来改变社会的现状,促进社会和国家的发展与进步。因此,在民主法治的国家都会制定一系列的政治措施和法律来保障公民的表达自由权。有自由就会有限制,表达自由权亦不是绝对的自由,法律也会限制表达自由权。在实践当中,表达自由权也会和公共利益、国家利益以及他人的权利产生冲突,因此司法机关在保障表达自由权的同时,也应该衡量各种利弊。然而,限制其实是为了更好的保障表达自由,限制是手段,保障才是目的。 本文主要包括五个部分： 第一部分是公民表达自由权的概述,主要介绍表达自由的基本理论问题,包含表达自由的概念和价值。第二部分是表达自由的保障,主要阐述政治和法律保障表达自由权的行使。第三部分是表达自由的限制,主要分析了限制的法理以及列举了一部分在实践中可以限制表达自由权的理由。第四部分主要阐释的是宪法和法律规制表达自由时所应遵循的原则。第五部分主要说明我国关于表达自由权的现状和问题,并提出一些建议和设想。
[Abstract]:Freedom of expression is the cornerstone of democratic politics and the basic right of citizens. It is of great significance and value to the development and progress of human society. In short, freedom of expression means that people express their thoughts and consciousness through words and expressions. Citizens can express their dissatisfaction with and criticism of society by virtue of their right to freedom of expression, and only after they have expressed their thoughts. Only then can these ideas be adopted to change the social situation and promote the development and progress of the society and the country. Therefore, in democratic and legal countries, a series of political measures and laws are made to protect citizens' right to freedom of expression. Freedom is limited, freedom of expression is not absolute, and law limits the right to freedom of expression. In practice, the right to freedom of expression also conflicts with the public interest, the national interest and the rights of others, so the judiciary should weigh the advantages and disadvantages while safeguarding the right to freedom of expression. However, restrictions are actually for better protection of freedom of expression, restrictions are means, and security is the end. This paper mainly includes five parts: the first part is an overview of the right to freedom of expression of citizens, mainly introduces the basic theoretical issues of freedom of expression, including the concept and value of freedom of expression. The second part is the guarantee of freedom of expression, mainly expounds the political and legal guarantee of the exercise of the right to freedom of expression. The third part is the restriction of freedom of expression, mainly analyzes the legal principle of restriction and enumerates some reasons why the right to freedom of expression can be restricted in practice. The fourth part mainly explains the principles that should be followed in the regulation of freedom of expression by constitution and law. The fifth part mainly explains the present situation and problems about the right to freedom of expression in China, and puts forward some suggestions and ideas.
