立法原则的伦理价值探析

【摘要】：法律是人类实践理性的产物，是规范人的行为的准则。立法的目的在于创制良法，而良法的制定从某种意义上讲有赖于科学、合理的立法原则的指引。长期以来，人们在立法实践中忽略了伦理价值对制定良法的重要性，许多立法缺乏内在合理性和科学性，法律运行的效果并不理想，严重影响了法律的权威和尊严。立法中的这一重大理论与实践问题也并没有引起学界的高度关注，，立法的伦理学研究尚处于初始阶段，立法伦理学的研究成果很少。因此，从某种意义上讲，立法的伦理分析是一个开拓性的研究课题。为了能够将立法原则的伦理价值这一问题阐述的更加清晰，笔者首先通过对伦理和立法原则概念的进一步界定来说明伦理在立法原则中的体现以及立法原则引入伦理因素的必要性。在分析了立法原则引入伦理因素的必要性的基础上，文章进一步阐述了理性是立法原则的伦理基础；在该部分中，笔者通过对“理性”的解读，认为理性是沟通立法原则与伦理因素的纽带，合理性、公意性和主客观一致性三个方面是理性在立法原则中的客观表现；文中还就正义和利益是立法原则的伦理内涵这一问题进行详细地阐述，即正义和利益是立法原则的伦理价值追求，二者缺一不可。最后，笔者认为在立法原则同伦理发生融合的过程中，立法原则的伦理进路发生了异化和归同，这两种进路分别是指共同理性向立法者意志的异化和人权向公民权的异化，以及立法者意志与共同理性的归同和公民权与人权的归同。
[Abstract]:Law is the product of human practical rationality and the norm of human behavior. The purpose of legislation is to create good laws, and the formulation of good laws in a sense depends on the guidance of scientific and reasonable legislative principles. For a long time, people have neglected the importance of ethical value to the establishment of good law in legislative practice. Many legislation lacks inherent rationality and science, and the effect of law operation is not ideal, which seriously affects the authority and dignity of law. This important theoretical and practical problem in legislation has not attracted much attention of the academic circles. The research on legislative ethics is still in the initial stage, and the research results of legislative ethics are very few. Therefore, in a sense, the ethical analysis of legislation is a pioneering research topic. In order to be able to articulate more clearly the ethical value of legislative principles, Firstly, the author explains the embodiment of ethics in the legislative principles and the necessity of introducing ethical factors into the legislative principles through the further definition of the concepts of ethics and legislative principles. On the basis of analyzing the necessity of introducing ethical factors into legislative principles, the article further expounds that rationality is the ethical basis of legislative principles, in this part, the author interprets rationality. Rationality is the link between legislative principles and ethical factors. Rationality, public will and subjective and objective consistency are the objective manifestations of rationality in legislative principles. The article also expounds in detail that justice and interest are the ethical connotation of the legislative principle, that is, justice and interest are the pursuit of ethical value of the legislative principle, both of which are indispensable. Finally, the author thinks that in the process of the integration of legislative principles and ethics, the ethical path of legislative principles has been alienated and homogenized, which refers to the alienation of common rationality to the will of legislators and the alienation of human rights to citizenship respectively. And legislator will and common rational homogenization and citizenship and human rights identity.
