日本农业生产法人制度借鉴及中国培育新型农业经营主体的演进思路

【摘要】：党的十八大以来,中央加强了构建现代农业经营体系、培育新型农业经营主体的顶层设计。1962年,日本农业生产法人制度以《农地法》的法律形式而创设,经过后续不断修改完善和实践促进,目前已经形成了农事组合法人、合名公司与合资公司、有限公司、股份公司等多种形态,并且明晰了法人要件、事业要件、成员要件、业务执行役员要件,再配之财政、金融、中介服务措施,产生了良好的发展效益。中国根据"十三五"规划对新型农业经营主体的制度安排,其与日本农业生产法人制度具有一些内在的联系,需要有机借鉴日本农业生产法人制度的运行模式,通过构建具有中国特色的农业经营法律体系,明确新型农业经营主体的法律资格和条件,建立新型农业经营主体可持续发展的扶持、保障与监督体系,来更好地培育中国新型农业经营主体,以此解决当前中国农户兼业化、农业生产力较低等现实困境,推进"三农"问题在新形势下的破解与可持续演进。
[Abstract]:Since the 18th National Congress of the Party, the Central Committee has strengthened the construction of a modern agricultural management system and cultivated the top-level design of the new agricultural management mainstay. In 1962, the Japanese agricultural production legal person system was created in the form of the "Agricultural Land Law". After continuous revision and improvement and promotion in practice, various forms have been formed at present, such as agricultural combination legal persons, joint name companies and joint ventures, limited companies, joint-stock companies, and so on, and the requirements of legal persons, institutions, and members have been clarified. The requirements of operational staff, financial, intermediary service measures have produced good development benefits. According to the 13th Five-Year Plan, China has some internal relations with Japan's agricultural production legal person system, and it needs to learn from the operation mode of Japanese agricultural production legal person system organically. Through the construction of the legal system of agricultural management with Chinese characteristics, the legal qualifications and conditions of the new agricultural management subject are clarified, and the support, protection and supervision system for the sustainable development of the new agricultural management subject is established. In order to better cultivate the main body of new agricultural management in China, to solve the current Chinese farmers' concurrent industry, low agricultural productivity and other practical difficulties, to promote the "three rural areas" in the new situation of the solution and sustainable evolution.
