法律实施的基本范畴论纲

【摘要】：中国特色社会主义法律体系形成后,法律的有效实施成为我国今后法治建设的关键问题。解决法律实施的问题,应当研究法律实施的基本范畴,探求法律实施的基本规律。法律实施是一个与法律、法治和国家治理能力相关的概念,法律能否实施、能否有效果地实施、能否有效率地实施,是衡量法治建设水平和国家治理能力现代化的重要依据。法律实施的研究,应当关注法律实施的主体、方式、领域、成本等基本范畴。法律实施的主体论,研究法律的公共实施与法律的私人实施的问题。法律实施的方式论,研究法律的硬实施与软实施的问题。法律实施的领域论,研究法律在国家生活、社会生活和公民个人生活中实施的问题。法律实施的成本论,研究如何通过优化资源配置实现法律实施优化的问题。法律实施是跨学科研究,探讨法律实施的基本范畴和基本规律,可以作为设计、构建法律实施具体路径的参考依据。在具体设计时,在方法论上需要强调类型化与掌握平衡的问题。
[Abstract]:After the formation of the socialist legal system with Chinese characteristics, the effective implementation of the law becomes the key issue in the construction of the rule of law in the future. To solve the problem of law enforcement, we should study the basic category of law enforcement and seek the basic law of law enforcement. Law enforcement is a concept related to law, the rule of law and the ability of national governance. Whether the law can be implemented, whether it can be implemented effectively, and whether it can be implemented efficiently is an important basis for measuring the level of the construction of the rule of law and the modernization of the national governance capacity. The research of law enforcement should focus on the subject, mode, field, cost and so on. The subject theory of law enforcement studies the public enforcement of law and the private enforcement of law. On the way of law enforcement, studying the problem of hard enforcement and soft implementation of law. The implementation of the law in national life, social life and personal life of citizens. Based on the cost theory of law enforcement, this paper studies how to optimize the implementation of law by optimizing the allocation of resources. Law enforcement is an interdisciplinary study. It can be used as a reference for the design and construction of the specific path of law implementation. In the specific design, it is necessary to emphasize the problem of typology and mastering balance in methodology.
