论西夏的司法观念

【摘要】：司法观念引导着司法制度的制定与实施,西夏的司法观念深受儒家、法家及本民族习惯法的影响,尤其是儒家思想的影响在其制定的成文法典中表现最为突出。西夏的司法观念可以总结为四个重点:礼法结合,服制入律;宽仁慎刑,考证详审;明察功过,赏罚相当;以法治官,以法断罪。西夏司法观念的确立,说明西夏能够对中国传统思想辗转承袭,又能结合自身实际,从而形成特色鲜明的司法观念。
[Abstract]:Judicial concept leads to the formulation and implementation of judicial system. The judicial concept of Xixia is deeply influenced by Confucianism, Legalists and the customary law of this nation, especially the influence of Confucianism is the most prominent in its written code. The judicial concept of Xixia can be summed up as four key points: combination of etiquette and law, servitude into law; leniency, careful punishment, textual research and detailed examination; clear observation of merits and demerits, equal rewards and punishments; officials ruled by law, and crimes determined by law. The establishment of judicial concept in Xixia shows that Xixia can inherit Chinese traditional thought and combine with its own reality to form a distinctive judicial concept.
