如何开展科学的法治评估

【摘要】：正法治不是一个单向度的概念,控制滥用权力,强调规则之治,保障基本权利,维持社会秩序与安全等,都是法治所追求的目标。法治体现在立法、执法、司法、守法等一系列的过程中。通过法治指标评估法治状况,必然是多向度的,既可以在体现法治的各个环节的层次上进行,也可以在法治体系层次上进行。如何开展科学的法治评估,是当前一项重大的课题。法治评估的前提法治指标是一种特殊的社会指标,通过可以量化的数据描述和评价法治状况,判断所研究的现象从何
[Abstract]:The rule of law is not a unidirectional concept. The goal of the rule of law is to control the abuse of power, to emphasize the rule of law, to protect the basic rights and to maintain social order and security. The rule of law is embodied in a series of processes, such as legislation, law enforcement, judicature, law-abiding and so on. It is necessary to evaluate the state of the rule of law by the index of rule of law, which can not only be carried out at the level of each link of the rule of law, but also at the level of the system of rule of law. How to carry out scientific evaluation of the rule of law is a major issue at present. The premise of rule of law evaluation is a special social index. Through quantifiable data to describe and evaluate the rule of law, we can judge the phenomenon studied.
