从“工具主义法律观”到“治理主义法律观”:全面推进依法治国进程中的观念革命

【摘要】：工具主义法律观与现代化的国家治理体系和治理能力是不相容的。中国推进国家治理体系和治理能力现代化的成果大小取决于对工具主义法律观的扬弃程度。与此同时,西方国家理性主义法律观也难以在中华文明的土地上生根发芽。西方技术主义、繁琐主义、极端专业主义的法治体系和法治构造,严重扼杀了生机勃勃的法治精神。中国依法治国的观念基础在于实现从工具主义法律观向治理主义法律观的转变。治理主义法治观首先体现为对法治精神的尊崇,其次更注重法治在不同治理空间中的落实。法治在国家治理、社会治理和社区治理中的贯彻与落实存在着不同的实现路径。治理主义法律观关注的是法律能否转化为解决国家治理议题、社会治理议题和社区治理议题的观念资源和制度资源。从这个角度来说,法治的刚性程度在从国家治理向社会治理、社区治理传递的过程中,是逐渐递减的。换言之,法治在不同治理领域有不同的表现形式和制度形态。
[Abstract]:The legal view of instrumentalism is incompatible with modern national governance system and governance ability. The achievement of promoting the modernization of national governance system and governance capacity in China depends on the degree of sublation of instrumentalism legal view. At the same time, it is difficult for western countries to take root and sprout on the land of Chinese civilization. The rule of law system and structure of western technicalism, trivialism and extreme professionalism have seriously strangled the vigorous spirit of rule of law. China's concept of governing the country according to law is based on the transformation from the instrumentalism legal view to the governing legal view. The view of ruling by law embodies firstly the respect for the spirit of the rule of law, and then pays more attention to the implementation of the rule of law in different governance spaces. There are different ways to implement the rule of law in national governance, social governance and community governance. The legal view of governmentalism focuses on whether the law can be transformed into the conceptual and institutional resources for solving the issues of national governance, social governance and community governance. From this point of view, the rigidity of the rule of law in the process from national governance to social governance, community governance transmission, is gradually decreasing. In other words, the rule of law in different areas of governance has different forms of expression and system.
