柏拉图:法治政体类型学的始创

【摘要】：柏拉图在《国家篇》中提出并论证了"哲人政体",并在《政治家篇》里延续了对"真正的政制"的思考。但是,正是《政治家篇》将法治视为划分政体类型的一个基本标准,形成了关于法治政体的思想,从而开创了西方法政思想史上的法治政体类型学。而在《法篇》、《米诺斯》以及第七、八封书信中,柏拉图一方面进一步提升了法治的地位和意义,另一方面阐释了"混合政体"的主张与设想。柏拉图始创的法治政体类型学和"混合政体"思想,奠定了西方法治政体思想的基础。
[Abstract]:Plato put forward and demonstrated the "philosopher regime" in "the country", and continued to think about "the real political system" in the "statesman". However, it is the statesman that regards the rule of law as a basic criterion for the classification of the political system and forms the thought of the rule of law, thus creating the typology of the rule of law in the history of western legal thought. On the one hand, Plato promotes the status and significance of the rule of law, on the other hand, he explains the ideas and ideas of "mixed government". Plato's typology of the rule of law and the thought of "mixed regime" laid the foundation of the thought of the rule of law in the West.
