【摘要】：胡锦涛法治思想是中国共产党从当代社会主义法治建设的实践出发，吸收了马克思、列宁、毛泽东、邓小平、江泽民法治思想的基础上，对当代经济、政治、文化和法治发展的历史经验总结，是执政党对中国法治经验的理论升华。胡锦涛法治思想研究是以科学发展观、构建和谐社会理论和社会主义荣辱观等当代中国特色社会主义理论为指导，从胡锦涛同志讲话、中央文件、政治局学习资料中提炼胡锦涛法治思想内容和价值。 本文通过文献研究方法，力图从胡锦涛同志的讲话、中央文件、9次政治局关于法治建设集体学习资料中提炼、分析、归纳、总结胡锦涛法治思想,并清晰地界定胡锦涛法治思想的形成、成熟、继续发展三个阶段。其中，本文将其内容归纳为和谐法治观、人本法治观、民主法治观、法治与德治相结合思想、树立社会主义法治理念和弘扬法治精神思想、高度重视法治宣传教育思想等六个方面。而胡锦涛法治思想的价值在于进一步继承和发展了马克思法治思想，为经济发展保驾护航，促进民主政治进一步发展，是和谐社会建设的有力保证，，推动科学发展观的贯彻落实等五个方面。 法治作为一种治国方略须臾离不开现实的国情。通过研究，本文着重地分析了当前社会经济、政治、法治信仰的具体情况。为解决现实问题，以胡锦涛为中心的党中央创造性的采取了各项措施，其中就包括法治手段。文章力图从分析依法治国的各项措施出发提炼每一个观点。这种思路既体现了经济基础决定上层建筑，又反映了作为上层建筑的法治思想对经济基础的能动反作用，是彻底的历史唯物主义观点。
[Abstract]:Hu Jintao's thought on the rule of law is based on the practice of the construction of the contemporary socialist rule of law by the Communist Party of China, absorbing the thoughts of Marx, Lenin, Mao Zedong, Deng Xiaoping, Jiang Zemin on the rule of law, and on the contemporary economy and politics. The summary of historical experience in the development of culture and rule by law is the theoretical sublimation of the ruling party's experience of China's rule of law. Hu Jintao's thought on the rule of law is guided by the scientific concept of development, the theory of building a harmonious society and the socialist theory of socialism with Chinese characteristics. Politburo study materials to refine Hu Jintao's ideology and value of the rule of law. Through the method of literature research, this paper tries to extract, analyze, summarize and summarize Hu Jintao's thoughts on the rule of law from the speeches of Comrade Hu Jintao, the documents of the Central Committee, and the 9 collective learning materials of the political Bureau on the construction of the rule of law. And clearly define the formation of Hu Jintao's thought of the rule of law, mature, and continue to develop three stages. Among them, the content of this paper is summarized as the harmonious view of the rule of law, people-oriented view of the rule of law, democratic view of the rule of law, the combination of the rule of law and the rule of virtue, the establishment of the socialist concept of the rule of law and the promotion of the spirit of the Attach great importance to the rule of law, propaganda, education, and other six aspects. The value of Hu Jintao's thought of the rule of law lies in further inheriting and developing Marx's thought on the rule of law, protecting economic development and promoting the further development of democratic politics, which is a powerful guarantee for the construction of a harmonious society. Promote the implementation of the scientific concept of development in five aspects. The rule of law, as a strategy of governing the country, can not be separated from the reality of national conditions. Through the research, this article emphatically analyzes the current social economy, the politics, the rule of law belief concrete situation. In order to solve the practical problems, the CPC Central Committee with Hu Jintao as the center has creatively taken various measures, including the means of rule of law. The article tries to refine every viewpoint from the analysis of the measures of governing the country according to law. This kind of thinking not only reflects the economic basis determines the superstructure, but also reflects the dynamic reaction of the thought of rule of law to the economic base, which is a thorough historical materialism view.
