地方立法“不重复上位法”原则及其限度——以浙江省设区的市市容环卫立法为例

【摘要】：2015年修改的《立法法》新增了地方立法"不重复上位法"的规定,但在现实中这一规定并未得到有效落实,基于对浙江省设区的市市容环卫立法的考察和分析,可以发现地方立法重复率仍居高不下,并在地方立法权扩容的背景下有蔓延之势。究其原因,在于对不重复上位法重要性的忽视,事实上,地方立法不重复上位法是地方立法的一项重要原则,其体现了地方立法中一致性与地方性的平衡,与不抵触上位法共同构成了地方立法的界限。同时,还需关注到不重复上位法原则的限度,现实中可基于规范结构的完整性、法条之间的关联性等因素承认一定范围内"必要重复"的情形。
[Abstract]:The Legislative Law, which was amended in 2015, has added the stipulation of "not duplicating the epigyny law" in local legislation, but in reality this provision has not been effectively implemented, based on the investigation and analysis of the legislation on city appearance and sanitation in Zhejiang Province, which is divided into districts. It can be found that the repetition rate of local legislation is still high and spread under the background of the expansion of local legislative power. The reason lies in the neglect of the importance of not repeating the epistatic law. In fact, the local legislation not repeating the epistatic law is an important principle of the local legislation, which embodies the consistency and the local balance in the local legislation. And does not contravene the upper position law to constitute the local legislation boundary together. At the same time, we also need to pay attention to the limitation of the principle of non-repetition of epistatic law. In reality, we can recognize the situation of "necessary repetition" in a certain range based on the integrity of the normative structure and the relevance of the laws.
