法律与认识论:判断的一个说明

【摘要】：借助索萨(Sosa)关于信念的实施模型,我们提供了法律情形中的优异判断的一个模型。在提供模型的过程中,当代认识论文献对法律,尤其是对法律情形中优异判断的相关性是值得关注的。一个好的审判取决于证据的合适处理,还是实体判决如何构成,二者是不同的。分别由法官和陪审团做出的适切判决之不同也需要讨论。
[Abstract]:With the help of Souza (Sosa) 's model of implementation of belief, we provide a model of superior judgment in legal situations. In the process of providing the model, the relevance of contemporary epistemological literature to the law, especially to the excellent judgment in the legal situation, is worthy of attention. A good trial depends on the proper handling of the evidence or the constitution of the substantive judgment. The difference between appropriate decisions made by judges and juries also needs to be discussed.
