从经济的嵌入性看法律的嵌入性及其基本形态

【摘要】：从格氏的经济的嵌入性概念和有关论述看,法律不仅存在嵌入性,而且嵌入社会的广度和深度强于经济。根据经济的嵌入性存在的基本理论形态,法律的嵌入性的理论形态也可以分为零嵌入性和低度社会化、强嵌入性和过度社会化、弱嵌入性和中度社会化。根据嵌入度的不同,法律的嵌入性的实践形态可分为低嵌入度的法律、高嵌入度的法律和中嵌入度的法律。法律的嵌入性是一种为中国制度安法律之家尤其是法律理论之家的法律理论。
[Abstract]:From the concept of economic embeddedness and related exposition, the law not only has embeddedness, but also the breadth and depth of embedding society is stronger than that of economy. According to the basic theoretical form of the existence of economic embeddedness, the theoretical form of legal embeddedness can also be divided into zero embeddedness and low degree socialization, strong embeddedness and excessive socialization, weak embeddedness and moderate socialization. According to the different degree of embeddedness, the practice form of law's embeddedness can be divided into the law of low degree of embedding, the law of high degree of embedding and the law of middle degree of embedding. The embeddedness of law is a kind of legal theory which is the home of law, especially the house of legal theory.
