地方人大立法听证制度研究
[Abstract]:Legislative hearing is a representative democratic practice in our country. While it has been widely concerned by the society, it has been brought into our country late, and the relevant legislation and theory research is not perfect, in addition to the influence of the special legal and cultural background of our country. Compared with some western countries which have been in practice for a long time and have perfect system, there are still many problems and shortcomings in legal orientation and practical operation, which leads to legislation hearing as "open door legislation". When a system of democratic legislation was put into practice, it met with many practical problems. Through the analysis of the current situation of the local people's Congress legislative hearing and the comparative study of the examples of the local people's Congress legislative hearing, this paper points out the problems existing in the local people's Congress legislative hearing and analyzes the causes of its formation. Finally, the author puts forward some pertinent suggestions on the formulation of the rules of the legislative hearing, the perfection of the mechanism of determining the statement of the legislative hearing and the mechanism of the protection of rights, the perfection of the procedure of the legislative hearing, the effectiveness of the results of the legislative hearing, and so on. To improve and improve the local people's Congress legislative hearing system to provide useful exploration.
