土库曼斯坦共和国投资法律制度研究

【摘要】：外国投资法律制度是一国法律制度的重要组成部分，其对于吸引投资，促进经济发展，保障投资者合法权利有着极为重要的作用。土库曼斯坦是中亚地区重要的政治经济实体，其政治经济的发展对于我国而言存在着十分重要的影响。随着全球经济一体化的深入，，我国与土库曼斯坦之间的经济交往将更为频繁，因此对土库曼斯坦投资法律进行深入研究具有十分重要的现实意义。 笔者以土库曼斯坦政府在2008年10月16日颁布的《外国投资法》作为本文研究的核心，结合土库曼斯坦的其他相关法律法规，以国际投资法的基本理论分析为切入点，运用理论研究法、比较研究法等分析方法，以发展的视角着重分析土库曼斯坦投资法律制度的基本内容，并在此基础上对土库曼斯坦投资法律制度作出了客观的评析，期望能够为我国投资者向土库曼斯坦投资规避法律风险提供若干防范对策及建议。
[Abstract]:The legal system of foreign investment is an important part of a country's legal system, which plays an extremely important role in attracting investment, promoting economic development and protecting the legal rights of investors. Turkmenistan is an important political and economic entity in Central Asia. With the deepening of global economic integration, the economic exchanges between China and Turkmenistan will be more frequent, so it is of great practical significance to study the investment laws of Turkmenistan. The author takes the Foreign Investment Law promulgated by the Government of Turkmenistan on October 16, 2008 as the core of this study, and combines with other relevant laws and regulations of Turkmenistan, taking the basic theoretical analysis of the international investment law as the breakthrough point. In this paper, the author analyzes the basic contents of Turkmenistan's investment legal system from the perspective of development, and makes an objective assessment of Turkmenistan's investment legal system based on the theoretical research method and comparative research method. It is expected to provide some countermeasures and suggestions for Chinese investors to invest in Turkmenistan to avoid legal risks.
